HomeMy WebLinkAboutCity Council Resolution 2004-478CITY OF PLYMOUTH RESOLUTION 2004-478 APPROVING FINDINGS OF FACT FOR REZONING OF LAND LOCATED AT THE SOUTHWEST CORNER OF STATE HIGHWAY 55 AND VICKSBURG LANE (2004112) WHEREAS, CSM Equities, LLC has requested reclassification of the zoning from I-1 (Light Industrial) to PUD (Planned Unit Development) for property currently legally described as Lot 1, Block 1, Spicer Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from I-1 to PUD. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by CSM Equities, LLC for reclassification of the zoning from I -I to PUD, based on the following findings: 1. The proposed PUD zoning would be consistent with the Comprehensive Plan and other City policies and plans. 2. The proposed PUD zoning would provide the City with a higher level of regulatory control than could be achieved under conventional zoning. 3. The development would incorporate common elements in the design and materials for buildings, as well as for landscaping and the walkway system, in order to create a unified development. 4. There is adequate infrastructure to support the proposed development and rezoning of the parcel. Resolution 2004-478 (2004112) Page 2 ADOPTED by the City Council on November 9, 2004.
