APPROVING A SITE PLAN, INTERIM USE PERMIT AND VARIANCES FOR HERITAGE
DEVELOPMENT OF MINNESOTA TO ALLOW THE CONSTRUCTION OF "PLYMOUTH
CROSSING' A 30 -UNIT MULTIPLE FAMILY DEVELOPMENT LOCATED AT THE
SOUTHWEST CORNER OF THE INTERSECTION OF SCHMIDT LAKE ROAD AND
NORTHWEST BOULEVARD (2004116)
WHEREAS, Heritage Development of Minnesota has requested approval of a site plan, interim
use permit and variances to constrict a 30 -unit multiple -family development on property legally
described as follows:
The north 7 acres of the northwest quarter of the southeast quarter, Section 10, Township
118, Range 22, Hennepin County, Minnesota, together with that part of vacated Medicine
Lake Drive West accruing thereto.
WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Heritage
Development of Minnesota for a site plan, interim use permit and variances to allow the
constriction of "Plymouth Crossing," a 30 -unit multiple -family development located at the
southwest corner of the intersection of Schmidt Lake Road and Northwest Boulevard, subject to
the following conditions:
1. Approval of the site plan, interim use permit, and variances is contingent upon City approval
of the rezoning of the site to RMF -3 (Multiple Family 3).
2. A site plan is approved to allow constriction of the 30 -unit multiple -family development, in
accordance with the plans received by the City on October 13, 2004 and September 13 and
23, 2004, except as may be amended by this resolution.

3. An interim use permit is approved to allow a reduction in the number of required parking
spaces from 75 to 70 for the development, based on the findings that the applicable standards
in Section 21020 have been met and subject to the following conditions:
a. The applicant shall include language in the homeowners' association documents that
prohibit the storage of recreational vehicles and equipment in any parking space on the
property.
b. The interim use permit shall terminate if City staff documents a parking problem
associated with inadequate parking. If a parking problem is documented, the developer
would be required to create additional stalls on the site.
4. Variances are approved to allow 1) a private drive over 150 feet in length to be constricted
without a turnaround; 2) Buildings A and B set back 13 feet from Underwood Lane and 41
feet from Schmidt Lake Road; 3) Building C set back 45 feet from Schmidt Lake Road; and
4) the required drive aisle providing access to Building C set back four feet based upon the
finding that the applicable variance standards as listed in Section 21030.03 of the Zoning
Ordinance have been met.
5. Separate building, grading and utility permits are required prior to the commencement of any
constriction related to the project.
6. As part of the final plat application, the applicant shall submit a lighting plan showing all
lighting proposed on the property in conformance with the Zoning Ordinance as well as the
location of all street lights in the public rights-of-way in conformance with the Subdivision
Ordinance.
7. Twenty percent of the proposed units shall be affordable as defined by the regional guideline
when the final plat is approved.
8. Standard Conditions:
a. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
b. The permit is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
c. This approval shall expire one year after the date of approval, unless the property owner
or applicant has substantially started constriction of the project, or unless the landowner
or applicant has received prior approval from the City to extend the expiration date for up
to one additional year, as regulated under Sections 21045.09 and 21030.06 of the Zoning
Ordinance.
