HomeMy WebLinkAboutCity Council Resolution 2004-473CITY OF PLYMOUTH RESOLUTION 2004-473 APPROVING A PRELIMINARY PLAT FOR HERITAGE DEVELOPMENT OF MINNESOTA FOR "PLYMOUTH CROSSING", A 30 -UNIT, MULTIPLE -FAMILY DEVELOPMENT LOCATED ON THE SOUTHWEST CORNER OF THE INTERSECTION OF SCHMIDT LAKE ROAD AND NORTHWEST BOULEVARD (2004116) WHEREAS, Heritage Development of Minnesota has requested approval of a preliminary plat for Plymouth Crossing, a plat of three unit lots for 30 multiple -family dwellings, one common area lot and one outlot on six acres located on the southwest corner of the intersection of Schmidt Lake Road and Northwest Boulevard; and WHEREAS, the property is legally described as follows: The north 7 acres of the northwest quarter of the southeast quarter, Section 10, Township 118, Range 22, Hennepin County, Minnesota, together with that part of vacated Medicine Lake Drive West accruing thereto. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Heritage Development of Minnesota for a preliminary plat for Plymouth Crossing, subject to the following conditions: 1. Approval of the preliminary plat is contingent upon City approval of the rezoning of the site to RMF -3 (Multiple Family 3). 2. This preliminary plat approves three unit lots for 30 multiple -family dwellings, one common area lot and one outlot, in accordance with the plans received by the City on October 13, 2004 and September 13 and 23, 2004 except as amended by this Resolution. As part of the final plat application, the applicant shall provide the City with copies of the homeowner's association (HOA) documents for the neighborhood. 4. As part of the final plat application, the applicant shall provide the City with plans that include the location of all proposed street lights in the public right-of-way as well as a luminaire plan for all lighting proposed on private property in conformance with Section 21105.06 of the Zoning Ordinance. 5. As part of the final plat application, the applicant shall provide the City with revised elevations that demonstrate the location of the proposed facade materials. The applicant shall also include detailed elevations of the trash enclosures. 6. As part of the final plat application, the applicant shall provide the City with a revised landscaping plan showing sod installed in all disturbed areas outside the wetland buffers in conformance with the Zoning Ordinance. 7. As part of the final plat application, the applicant shall provide copies of the Homeowners' Association documents. 8. Prior to recording the final plat, the developer shall pay the park dedication fees, pursuant to City Code at the time the final plat is approved, for the total number of units shown on the plans. 9. Prior to issuance of a grading permit, the tree preservation fencing shall be installed and inspected and the required financial guarantee shall be submitted. 10. A trail shall be constricted across the entire property within the right-of-way for Schmidt Lake Road. Financial guarantees for completion of this item shall be included in the development contract. 11. Development standards shall be as required by the RMF -3 district. No variances are granted or implied, with the exception of those approved by the City Council by separate resolution. 12. Engineering conditions: a. As part of the final plat application, the applicant shall revise the final plat to provide additional drainage and utility easements over Lots 1 and 2 making the total distance from the right-of-way of Underwood Lane 10 feet. b. Prior to approval of the final plat, the applicant shall submit the required area charges (the water area change is $13,524.80 and sewer is $7,532.80) or request the charges be assessed. Prior to recording the final plat, the applicant shall provide a trail easement along Schmidt Lake Road and Northwest Boulevard so there is a minimum of four feet between the edge of the trail and the easement or right-of-way line. d. Prior to the issuance of any permits, the applicant shall submit copies of the required permits from Hennepin County, MPCA, Minnesota Department of Health, Shingle Creek and NPDES. e. As part of the final plat application, the applicant shall revise the plans as follows: i. Provide sanitary sewer clean -outs and note the invert elevations for both cleanouts for the sanitary sewer to Building A and for both cleanouts for the sanitary sewer to Building B. ii. Provide a street section design based on Standard Detail STRT-2. iii. Clearly note on the plans that the intersection for both driveways at Underwood Lane will constricted as outlined in Standard Detail STRT-5A. iv. Include details for catch basins, manholes, fire hydrants, manholes (standard and outside drop) gate valves. V. Submit a plan profile sheet for the storm sewer from CBMH 104 to the N [_]RP Pond. This portion of the storm sewer system will be public. vi. Note that the last three joints at the flared end sections will be tied. Include Details ST -3 and ST -3A on the plan sheets. vii. Note the location of the emergency overflow for building C. It shall be 1.5 feet below the low floor elevation. viii. Show swales at a minimum of 13/4% slope. ix. Show the top and bottom elevations for the retaining walls. X. Provide a separate plan sheet for the public watermain. xi. Show the trunk sanitary sewer on the plans. xii. Note what utilities are public and private on the plans. xiii. Eliminate all retaining walls in the right-of-way. xiv. Show the location and elevation of a rip rap overflow for the pond. xv. Provide a drainage system plan that shows the roof water draining to the water - quality pond. f. A development contract will be required for this project. g. The developer is responsible for the cost and installation of the necessary public and private traffic and street signs. h. The watermain extension from the watermain in Wynfield Place to Schmidt Lake Road will be public along with the watermian parallel to Schmidt Lake Road. 13. Fire Prevention Conditions: a. Fire apparatus access roads (fire lanes) shall be designed and maintained to a minimum seven -ton driving capacity. b. As part of the final plat application, the plans shall be revised to include the required fire lane constriction detail and the "No Parking Fire Lane" policy as a detail. The locations of the fire lane signs shall be revised accordingly. Resolution 2004-473 Preliminary Plat (2004116) Page 4 c. As part of the final plat application, revise the plans to relocate the fire hydrant located at the southwest corner of Building C to the southwest side of the three parking stalls and the fire hydrant in the southeast corner of Building A to the east side of the driveway and 3.5 feet north of the retaining wall. d. As part of the final plat application, submit fire flow calculations flowing the two new remote hydrants on Schmidt Lake Road simultaneously. Each hydrant must be capable of flowing a minimum of 1500 GPM at 20 PSI residual pressure. e. As part of the final plat application, revise the plans to relocate the fire department connection on each building to an approved location and identify the location on the plan. f. As part of the final plat application, the applicant shall revise the plans to show all exterior storage and dumpster locations a minimum of five feet from combustible walls, openings in walls and combustible roof eave lines. g. All buildings shall be protected by a City approved NFPA 13 fire sprinkler system. All areas of each building shall be protected, including the attics and parking garages. h. Each building fire sprinkler system must be monitored by a UL central station with a UL Certificate on the system. The post indicator valve, the system flow switches, and all system control valves must be monitored by a UL central station. i. An approved solenoid device is required to be connected between the building fire sprinkler system and the building/site domestic water supply if a combination fire and domestic water supply line is used. j. A City -approved Plymouth Fire Department lockbox shall be installed in an approved location on each building. k. Prior to final building approval, the applicant shall submit an approved reproducible 8'/z inch by 11 inch site/building as -built fire protection plan and an approved building floor plan to the fire inspector. 14. Standard Conditions: a. Removal of all hazardous trees from the property at the owner's expense. b. The HOA shall be responsible for maintenance of the signs, plantings, mailboxes, monument signs, sidewalks, retaining walls, wetland buffers and all common areas within this development. The HOA documents shall include language to address maintenance of these features. The documents shall also include prohibitions on the storage of recreational vehicles and equipment in any of the parking spaces on the property. c. No building permits shall be issued until the wetland buffer monuments have been installed and inspected. d. Removal of hazardous trees from the property at the owner's expense. e. No building permits shall be issued until a contract has been awarded for sewer and water. f. No building permits shall be issued until the final plat, development contract, easements, maintenance agreements, and HOA documents are filed and recorded with Hennepin County and proof of recording is received by the City. g. Streets names shall comply with the City Street Naming System. Resolution 2004-473 Preliminary Plat (2004116) Page 5 h. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. i. Signs shall require separate permits prior to installation. j. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. k. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility.
