HomeMy WebLinkAboutCity Council Resolution 2004-470CITY OF PLYMOUTH RESOLUTION 2004-470 APPROVING ENCROACHMENT AGREEMENTS FOR RETAINING WALL AT 5115 AND 5125 IVES LANE WHEREAS, Bradley & Virginia Kalin of 5115 Ives Lane and Lorne & Cynthia Pederson of 5125 Ives Lane have requested approval to execute individual encroachment agreements to constrict a retaining wall; and; WHEREAS, the encroachment agreements only permit the encroachment of the retaining wall within the easement and all related facilities must still meet all applicable City codes; and WHEREAS, the properties are legally described as Lots 2 and 3, Block 1, Palmer Creek Estates 4th Addition; NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on behalf of the City of Plymouth individual encroachment agreements allowing the constriction of a retaining wall per plans, approved by the City Engineer, within the public drainage easement at 5115 and 5125 Ives Lane. Adopted by the City Council on November 9, 2004. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS. The undersigned, being the duly qualified and appointed City Clerk of the City of Plymouth, Minnesota, certifies that I compared the foregoing resolution adopted at a meeting of the Plymouth City Council on November 9, 2005, with the original thereof on file in my office, and the same is a correct transcription thereof.
