HomeMy WebLinkAboutCity Council Resolution 2004-463CITY OF PLYMOUTH RESOLUTION 2004-463 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR "PLYMOUTH OFFICE PLAZA" LOCATED SOUTH OF OLD ROCKFORD ROAD AND WEST OF PEONY LANE (2004051-F) WHEREAS, Terra Form, LLC has requested approval of a final plat and development contract to allow constriction of an I1 -unit town office condominium development in three buildings on a 3.64 -acre site presently legally described as follows: That part of the Southeast quarter of Section 7, Township 118, Range 22 which lies South of County Road No. 9, except that portion platted in Osier Addition; and that part of the West half of the Northwest quarter of the Northeast quarter of Section 18, Township 118, Range 22 which lies Northeasterly of Osier Addition, except that part lying within County Road No. 9, Hennepin County, Minnesota. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve a final plat for Terra Form, LLC for "Plymouth Office Plaza", and, FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. This final plat approves two lots for eleven town office condominiums in three buildings, in accordance with the plans received by the City on October 4, 2004, except as may be amended by this Resolution. Prior to recording the final plat, the applicant shall pay all fees and charges noted in the development contract, except that the applicant shall pay the required park dedication fee prior to issuance of any building permits. 3. Prior to recording the final plat, the applicant shall provide any easements or maintenance agreements identified in the development contract. 4. No outside storage is allowed on the site. 5. All waste and waste containers shall be stored within an enclosure stricture or in an interior trash room. 6. The dumpster enclosure indicated on each lot shall be designed to be compatible with the buildings, and shall comply with the zoning ordinance. 7. No medical, dental, or chiropractic office uses or clinics shall be permitted in any unit within the development. 8. Prior to issuance of building permits, the applicant shall provide the City with a copy of the CIC (Common Interest Community) documents and any other related association documents for the development. The documents shall address maintenance of the common areas and the prohibition of medical/dental/chiropractic uses and clinics within the project based on the City's parking requirement. 9. Prior to issuance of any building permits, the applicant shall further revise the landscape plan to update the planting schedule, and replace the common juniper with maney or mint julep juniper in a manner that provides a hedgerow between all parking spaces that face toward Old Rockford Road. 10. Any signage shall require separate sign permits prior to installation and shall be in conformance with the Zoning Ordinance. 11. The signage on the building facades shall consist of individual metal letters within the designated signboard area (above the doorways) and shall not be back lit. The only freestanding sign allowed for the development shall be an area identification sign located near the site entrance at Old Rockford Road, and shall be constricted of pre -finished metal placed upon a brick base. Only the letters for the freestanding sign shall be translucent and lit from an internal light source. The freestanding sign shall be oriented at a right angle to Old Rockford Road so it does not face directly towards the residential area north of that road. 12. Prior to issuance of building permits, the applicant shall provide a final street lighting plan. 13. Standard Conditions: a. No building permits shall be issued until a contract has been awarded for sewer and water. Resolution 2004-463 (2004051-F) Page 3 b. No building permits shall be issued until the final plat, development contract, easements, maintenance agreements, and HOA documents are filed and recorded with Hennepin County and proof of recording is received by the City. c. Removal of all hazardous trees from the property at the owner's expense. d. Street names shall comply with the City Street Naming System. e. All lighting installed on private property shall conform to the Zoning Ordinance. f. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. g. The applicant shall comply with the Ordinance regarding the location of fire hydrants, lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane signage. h. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any financial guarantees per City Ordinance. i. This final plat approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for an additional period, as regulated under Section 512 of City Code.
