RESOLUTION NO. 2004-453
AUTHORIZING THE VACATION OF
DRAINAGE AND UTILITY EASEMENTS OVER
LOTS 5, 6, 7 AND 8, BLOCK 1, PLUM TREE EAST 8TH ADDITION
WHEREAS, a public hearing with respect to said vacation was scheduled for October 26, 2004 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of October 26, 2004; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on October 26, 2004 to inform any and all
interested parties relevant to the vacation of drainage and utility easements in Plum Tree East 8th
Addition; and
WHEREAS, it was determined by the City Council that said easements were not needed for public
purposes; and
WHEREAS, new drainage and utility easements will be granted over the adjusted lots lines;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following drainage and utility easements be vacated:
All drainage easements and the drainage and utility easements, originally dedicated on the recorded
plat of PLUM TREE EAST 8TH ADDITION, which lie within Lots 5, 6, 7 and 8, Block 1 in said plat.
