RESOLUTION 2004-438
APPROVING A CONDITIONAL USE PERMIT FOR BENJAMIN STEINKRAUS TO
ALLOW A DETACHED GARAGE OVER 1,000 SQUARE FEET ON PROPERTY
LOCATED AT 5910 LAWNDALE LANE NORTH (2004027)
WHEREAS, Benjamin Steinkraus has requested a conditional use permit to allow a 2,304
square -foot detached garage on property legally described as follows:
That part of the South half of the Northwest quarter of Section 5, Township 118 North,
Range 22 West of the 5"' Principal Meridian, Hennepin County, Minnesota, described as
follows:
Commencing at a point on the West line of the South half of the Northwest quarter a
distance of 439.86 feet South of the Northwest corner of said South half of the Northwest
quarter; thence South along said West line, a distance of 200 feet; thence deflect 91
degrees 36 minutes left a distance of 756.73 feet to the centerline of Elm Creek; thence
deflect 51 degrees '15 minutes left along said centerline a distance of '18.17 feet; thence
deflect 25 degrees 18 minutes left along said centerline a distance of 174.57 feet; thence
deflect 103 degrees 07 minutes left a distance of 824.48 feet to the point of beginning.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing, and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Benjamin Steinkraus for a conditional use permit, subject to the following
conditions:
1. A conditional use permit is approved to allow a 2,304 square -foot (48 feet by 48 feet)
garage, as shown on the application and plans received on March 17, 2004, additional

information on July 29, 2004 and September 28, 2004 except as may be amended by
this resolution.
2. The design and building materials for the detached garage must be compatible with the
principle stricture and be residential in character.
3. The detached garage shall be used for the storage of recreational vehicles and related
equipment and automobiles. The garage shall not be used for a home occupation or
other business related activities.
4. Prior to the issuance of a building permit, the plans shall be revised to demonstrate a
minimum of 15 feet from the edge of the delineated wetland to the footprint of the
detached accessory garage.
5. Prior to the issuance of a building permit, the plans shall be revised to demonstrate a
maximum of 400 square feet of wetland fill as approved with the Wetland
Conservation Act Certificate of Exemption.
6. Prior to the issuance of a building permit, the plans shall be revised to demonstrate a
minimum floor elevation of at least two feet above the 100 -year flood elevation.
7. A separate building permit is required prior to the commencement of constriction.
The design shall conform with the State Building Code and all applicable City Codes
including but not limited to: all building materials identified including a required
concrete floor, and being designed by a structural engineer.
8. Prior to footings inspection, the property irons on the north side of the property shall
be exposed, staked and connected by a string to confirm setbacks.
9. Standard Conditions:
A. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
B. The permit is subject to all applicable codes, regulations and ordinances, and
violation thereof shall be grounds for revocation.
C. This approval shall expire one year after the date of approval, unless the property
owner or applicant has substantially started constriction of the project, or unless
the landowner or applicant has received prior approval from the City to extend the
expiration date for up to one additional year, as regulated under Section 21015.07
of the Zoning Ordinance.
