RESOLUTION 2004-434
APPROVING A SITE PLAN AMENDMENT AND VARIANCE FOR THE CONSTRUCTION
OF ARCHITECTURAL SCREEN WALL AND SITE IMPROVMETNS AT 2735 CHESHIRE
LANE NORTH (2004115)
WHEREAS, the Renovation Systems has requested approval of a site plan amendment and
variance for property legally described as:
Lot 8, Block I of Industrial Park 494, Hennepin County, Minnesota; and
WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Renovation Systems for a site plan amendment and variance for the constriction of an
architectural screen -wall and site improvements, subject to the following conditions:
1. A site plan amendment and variance is approved to allow the constriction of a screen -
wall, and site improvements for Renovation Systems located at 2735 Cheshire Lane
North, in accordance with the plans received by the City on September 29, 2004, except
as amended by this resolution.
2. A variance is approved to allow a ten -foot side yard setback from the northern lot line for
an architectural screen -wall, where 15 feet are required by the Ordinance, as shown on the
plans dated August 26, 2004, based on the finding that:
a) The proposed location of the screen wall is the most logical and effective to
adequately screen the existing mechanical equipment from view. The design and

location of the building on the site require the screen wall to be located within the
required side yard setback.
b) Unlike most industrial buildings in Plymouth, the subject building does not meet a
number of the current zoning requirements.
c) The request is not based exclusively upon a desire to increase value or income
potential of the property. The proposed wall would screen existing mechanical
equipment on the site from view of the property to the north, as well as from Cheshire
Lane to the east.
d) The building has been non -conforming for a number of years.
e) The proposal would not be detrimental to the public welfare or injurious to other land
or improvements in the neighborhood. The staggered design of the screen -wall would
eliminate any obstruction of views for the neighboring property to the north, and
would screen the existing mechanical equipment from view from neighboring parcels.
f) The request has no impact on the supply of natural light and air to adjacent properties,
the amount of congestion on the public streets or adjacent property values.
g) The proposed variance is the minimum action required to eliminate the hardship. .
3. No strictures shall be permitted to encroach into the Cheshire Lane public right-of-way.
4. Drainage must be maintained through the 10 -foot public utility easement located along the
northern property line.
5. A building permit is required prior to constriction of the proposed improvements. Prior
to issuance of a building permit, the applicant shall submit detailed building plans for the
proposed improvements.
6. Prior to the issuance of a building permit an approved fire department connection must be
identified.
7. Approval shall expire one year after the date of approval, unless the property owner or
applicant has substantially started constriction of the project. The landowner or applicant
may apply for approval of an extension by the City, as regulated under Section 21045.09
of the Zoning Ordinance.
