RESOLUTION 2004-421
APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR ORRIN
THOMPSON HOMES FOR "TIMBER CREEK CROSSING, SECOND ADDITION"
LOCATED AT 51sT AVENUE NORTH AND EVEREST LANE (2004101F)
WHEREAS, Orrin Thompson Homes has requested approval of a final plat and development
contract for Phase 2 of "Timber Creek Crossing, Second Addition", a plat with 46 unit lots for
row -townhouse dwellings, three common open -space lots and one outlot on 17.25 acres located
at 51" Avenue North and Everest Lane North; and
WHEREAS, the property is legally described as follows:
Outlots A and B, Timber Creek Crossing, Hennepin County, Minnesota
WHEREAS, the City staff has prepared a development contract covering the improvements
related to said plat.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve a final plat for Orrin
Thompson Homes for Timber Creek Crossing, Second Addition, and,
FURTHER, that the development contract for said plat be approved, and that the Mayor and City
Manager be authorized to execute the development contract on behalf of the City; and,
FURTHER, that the following conditions be met prior to recording of, and related to said plat:
1. This final plat approves 46 unit lots for row -townhouse dwellings, three common open -space
lots and one outlot, in accordance with the plans received by the City on August 5, 2004 and
September 10, 2004, except as amended by this Resolution.

2. Prior to recording the final plat, the applicant shall submit revised plans which show the
driveway on Lot 1, Block 1 forty feet from the intersection of the rights-of-way for 51"
Avenue North and Fountain Lane.
3. Prior to recording the final plat, the applicant shall revise the plans to incorporate sidewalks
along one side of Everest Lane North and on the west side of Fountain Lane North.
4. Prior to recording the final plat, the developer shall pay the park dedication fees, pursuant to
the Development Contract, for the total number of units shown on the plans.
7--.5.With the application materials for the third addition, the applicant shall provide plans showing
the watermain looped and connected to the watermain on Comstock Lane and Schmidt Lake
Road.
6. With the application materials for the third addition, the applicant shall submit a revised
landscaping plan which incorporates additional screening east of the creek and north of 51"
Avenue North and behind the units on lots designated as Lots 132-138, Block 4 on the
preliminary plat.
7. With the application materials for the third addition, the applicant shall submit revised plans
showing the strictures on lots designated as Lots 89 and 90, Block 4 with the required 25 -
foot side -yard setback.
8. Prior to the issuance of any building permits, signs shall be posted in the following locations
notifying residents of the following items:
a. Located on the end of Fountain Lane North on or near the Gun Club property advising
potential property owners of the existence of the gun club, its hours of operation (which
are subject to change) and that repetitive, loud noise is produced during those hours. This
sign shall remain in place as long as the Gun Club is in operation.
b. At the farthest finished extent of Fountain Lane and 51" Avenue North alerting residents
to the temporary nature of the cul-de-sac.

9. Prior to issuance of any building permits, the applicant shall revise the disclaimers distributed
to potential homebuyers to specifically disclose the temporary nature of the cul-de-sac on 51"
Avenue North and Fountain Lane North.
10. Prior to issuance of any building permits, the applicant shall install a fence along the non -
wetland portion of the boundaries of the development and the 1) Plymouth Gun Club property
and 2) the railroad property.

4-411.Development standards shall be as required by the RMF -2 district.
4-6-.-12.The applicant shall be responsible for constricting the trail along Schmidt Lake Road and
51" Avenue North for the entire project.
13. Engineering Conditions:
a. Prior to recording the final plat, the applicant shall pay the following area charges:
$36,340 for water and $20,240 for sewer.
b. Prior to recording the final plat, the applicant shall submit the following easements:
i. A drainage and utility easement over all of Lot 6, Block 1; Lot 12, Block 2; and Lot
31, Block 3; 10 feet on each side of the watermain between Lots 4 and 5, Block 3; 10
feet on each side of the sanitary sewer and watermain in Private Drive A; and 10 feet
on each side of the storm sewer pipe between FES 1 and CBMH 2 located in the rear
yard between Fountain Lane and Everest Lane.
ii. Temporary street easements over 100 feet in diameter at the north end of Fountain
Lane and 100 feet in diameter at the east end of 51" Ave.
c. Prior to issuance of any permits, the applicant shall provide copies of the required permits
from MPCA, Minnesota Department Of Health, Elm Creek Watershed, NPDES, and
MNDOT — State Aid.
d. Minimum floor elevations shall be as follows: 1003.4 for Lots 5 through 13, Block 3;
1002.8 for Lots 1 through 4, and Lots 14 through 30, Block 3; 1006.5 for Lots 1 through
5, Block 1; and 1004.9 for Lots 1 through 4, Block 2.
e. Prior to recording the final plat, the applicant shall revise the plans as follows:
i. Show on grading plan all emergency overflows including elevations from the
wetland, pond, ravine, and low areas.
ii. Provide detailed grading and overflow elevations as it appears the lowest floor
elevations for Lots 5 through 11, Block 2 are too low.
iii. Grayscale the existing underlying storm sewer on the grading plan. Also clean it up
to make it more readable.
iv. Show top and bottom elevations of all retaining walls. Retaining walls over 4 feet
high require a separate permit from the Building Department and a safety fence
must be installed on top.
V. Indicate on the Stormwater Pollution Prevention Plan that the City requires the
streets to be swept a minimum of once per week.
vi. Remove from the second paragraph "within 200 feet of a surface water or any
storm water conveyance system which is connected to a surface water" on page 15
of 15 under "B Erosion Prevention Practices".
vii. Remove inlet protection detail on page 7 of 15.
viii. Insert City Details ST -19, ST -20, STRT- 16,17, & 18, and DWG -5A.
ix. Revise detail of street sections to comply with City Detail STRT-2 for base and
wearing course type.

X. Show the temporary turn around paved beyond the curb at the north end of
Fountain Lane and the east end of 51" Avenue. An 80 foot paved diameter is
required.
xi. Place barricades at the north end of Fountain Lane and 51" Ave. per detail STRT-
7.
xii. Remove detail W-5 from page 8 of 15.
xiii. Replace all 18 inch water main butterfly valves with gate valves.
xiv. Remove gate valve from north end of Fountain Lane near station 2+00.
xv. Add 18 inch gate valve on 51" Avenue East of the Tee for Everest Lane.
xvi. Show the irrigation service as an 18" x 4" Tee and a 4 inch gate valve between
Lots 4 and 5 Block 2, on 51" Ave.
xvii. Show the irrigation service as a 8" x 4" Tee and a 4 inch gate valve on Private
Drive A between Lots 18 and 19, Block 3.
xviii. Revise the plans to maintain a minimum of 18 inches of separation, including
details of the transition as there is a conflict between the sanitary services and the
watermain on 51" Ave.
xix. Revise the plans for the sanitary services to the east of Fountain Lane as they also
conflict with the watermain.
xx. Provide a profile for the storm sewer pipe between strictures I I and 3.
xxi. Lower the inverts of storm sewer manholes 11, 12, and 13 to provide a minimum
depth of 4 feet.
xxii. Correct the storm sewer casting grate covers on page 5 of 15. Refer to City Detail
ST -5. Use R-3067 with D.L., D.R. or type V grate for B618 curb at radius. Use
R-3501 for surmountable curb.
xxiii. Update Traffic Control Plan. Refer to City Details STRT-16, 17 and 18. Indicate
"No Parking" on 51" Avenue. Use new detail for Fire Lane Signage and show
locations per Fire Inspector.
xxiv. A public trail must be constricted per City Detail SPP -I along the south side of
51 �' Ave.
xxv. A sidewalk must be constricted along the east side of Everest Lane to Private
Drive A, and along the west side of Fountain Lane per City Detail STRT-2A.
xxvi. Show building type and low floor elevations on the grading plan.
xxvii. Pull back the contours adjacent to the emergency overflow behind Lots 5 through
8, Block 3 to provide a 4:1 slope and a 2 foot swale bottom while maintaining the
100 1. 9 overflow elevation.
xxviii. Install a hydrant on the end of the watermain in Private Drive A.
xxix. Revise Everest Lane to identify tipped out curb and cross slope on the cul-de-sac,
and grades across Private Drive A to ensure at least 0.5 % grade in the gutter line.
xxx. Revise the landscape plan to show all trees at least 10 feet from all pipes, and
include a note requiring it.
xxxi. Provide a final street lighting plan.

a. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release
or reduction of any site improvement financial guarantees per City Policy.
b. Prior to issuance of utility permits, revise the plans to relocate the hydrant on Fountain
Lane North to the west side of the end of the temporary turn around.
c. Prior to the issuance of permits, the traffic control plan shall be revised to remove the fire
lane signs proposed in front of lots 11, 13, 14, 18, 19 and the easternmost of the two signs
east of the guest parking spaces. Incorporate the most current detail onto the plans.
d. A City -approved automatic fire sprinkler system is required to protect all buildings.
e. An approved address/directional sign is required in an approved location at the
intersection of Everest Lane and the private drive that extends from the cul-de-sac.
4-7,15. Standard Conditions:
a. All constriction traffic shall enter the site from 51" Avenue North. No access shall be
permitted via the existing unpaved, Dunkirk Lane.
b. The HOA shall be responsible for maintenance of sidewalks, boulevard plantings, wetland
buffers, mailboxes, monument signs and association common areas within this
development. The HOA documents shall include language to address maintenance of
these features.
c. No building permits shall be issued until the wetland buffer monuments have been installed
and inspected.
b-d.Removal of all hazardous trees from the property at the owner's expense.
e, e. No building permits shall be issued until a contract has been awarded for sewer and water.
d -.f. No building permits shall be issued until the final plat, development contract easements,
maintenance agreements, and HOA documents are filed and recorded with Hennepin
County and proof of recording is received by the City.
fig_Street names shall comply with the City Street Naming System.
h. All lighting installed on private property shall conform to the requirements of Section
21105.06 of the Zoning Ordinance.
Iri_Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
strictures on sites adjacent to, or containing any open storm water drainage facility.
