RESOLUTION NO. 2004-415
REQUEST FOR PAYMENT NO. 8 AND FINAL
NATHAN LANE/LANCASTER LANE IMPROVEMENTS
CITY PROJECT NO. 1014
WHEREAS, the City of Plymouth as owner and Eureka Constriction, Inc., as contractor,
have entered into an agreement for Nathan Lane/Lancaster Lane Improvement Project,
City Project No. 1014, said agreement being dated May 22, 2002; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $1,706,412.43. One change order
was approved in the amount of $3,350.98. The value of the work to date
is $1,685,995.68 and is herewith approved. The project does not exceed
the original contract amount.
2. That the work performed by the contractor for Nathan Lane/Lancaster
Lane Improvements Project and certified to the Council by the Engineer as
acceptable, being the same, is hereby released from the contract except as
to the conditions of the performance bond, any and all legal rights of the
owner, required guarantees and correction of faulty work after final
payment.
3. Request for Payment No. 8 and Final in the amount of $37,497.82 to
Eureka Constriction, Inc. for the Nathan Lane/Lancaster Lane
Improvements Project is hereby approved and the City Finance Director is
hereby authorized and directed to pay the same forthwith.
