HomeMy WebLinkAboutCity Council Resolution 2004-414CITY OF PLYMOUTH RESOLUTION 2004-414 APPROVING A SITE PLAN AND CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION OF A SIX MILLION GALLON IN -GROUND DRINKING WATER RESERVOIR, PUMP HOUSE AND RELATED SITE IMPROVEMENTS FOR PROPERTY LOCATED AT 5025 VICKSBURG LANE NORTH (2004108) WHEREAS, the City of Plymouth has requested approval of a site plan and conditional use permits to allow constriction of a six million gallon in -ground drinking water reservoir, pump house and related site improvements on property legally described as follows: Outlot H, Nanterre, Hennepin County, Minnesota WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by the City of Plymouth to allow the allow constriction of a six million gallon in -ground drinking water reservoir, pump house and related site improvements on property located at 5025 Vicksburg Lane North, subject to the following conditions: 1. Approval is contingent on approval of the Comprehensive Plan amendment and rezoning by the City Council and the Metropolitan Council's review of, and response to, the Comprehensive Plan amendment. 2. A site plan is approved to allow a allow constriction of a six million gallon in -ground drinking water reservoir, pump house and related site improvements, in accordance with the plans received by the City on August 20, 2004 and September 9, 2004, except as may be amended by this resolution. 3. A conditional use permit is approved to allow constriction of essential service strictures (a six million gallon in -ground drinking water reservoir and pump house), based on the findings that the applicable standards in Section 21015 have been met, in accordance with the plans Resolution 2004-414 (2004108) Page 2 received by the City on August 20, 2004 and September 9, 2004, except as may be amended by this resolution. 4. Engineering Conditions: a. The contractor shall contact Sewer and Water Supervisor, Brian Young at 763-509-5992 24 hours prior to any public sewer/watermain connection. b. The contractor shall contact Street Supervisor Gary Smith, at 763-509-5993 24 hours prior to any constriction activity within City right-of-way and/or easements. c. The site plan shall comply with the City of Plymouth's current Engineering Guidelines or the State Plumbing Code, whichever applies. d. All site utilities shall comply with the State Plumbing Code. 5. Fire Conditions: a. An automatic fire sprinkler system is required to protect the entire booster station building. b. An approved solenoid device is required to be connected between the fire sprinkler system and the domestic water supply if the sprinkler and the domestic water are a combination line. 8. Standard Conditions: a. The applicant shall remove any diseased or hazardous trees. b. All signage shall comply with the Section 21155 of the Zoning Ordinance. c. All lighting shall comply with Section 21105.06 of the Zoning Ordinance. d. Building permits are required prior to the commencement of any constriction related to the project. e. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. f. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. g. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21015.07 of the Zoning Ordinance.
