HomeMy WebLinkAboutCity Council Resolution 2004-391CITY OF PLYMOUTH RESOLUTION 2004-391 APPROVING A VARIANCE TO ALLOW THE CONSTRUCTION OF AN ATTACHED GARAGE AT 12308 12TH AVENUE NORTH (2004109) WHEREAS, Janice Grandy is requesting approval of a variance to allow a garage addition to encroach five feet into the required 15 -foot side yard setback on property legally described as follows: Lot 7, Block 5, of Beacon Heights 1 st Addition WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval of the variance; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Janice Grandy for a variance to allow a garage addition to encroach six feet into the required 15 -foot side yard setback, subject to the following findings and conditions: 1. The variance to allow a two -car garage addition is approved in accordance with plans received by the City on August 13, 2004, based on the conclusion that the applicant has met the applicable standards, as follows: a.) The proposed location of the garage addition is the most logical based upon topographical constraints, the location of the existing home on the lot, and the design of the home. The drop in elevation to the rear yard would make it more difficult to constrict a garage in that location. b.) The existing home on the subject property currently does not have a garage. Most homes in the RSF-1 district have garages. Most of the neighboring homes have two- or three -car garages. Resolution 2004-391 Variance (2004109) Page 2 c.) The purpose of the variation is to allow for a garage addition where currently no garage exists. A garage is a common feature for homes in cold weather climates. d.) The conditions upon which the variance application is based are related to actions taken by previous homeowners, not by the applicant. The applicant purchased the home in 2001, and is unaware of any previous garage existing on the site. e.) The proposal would not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood. The applicant has staggered the design of the garage as to have less impact upon the property to the east. f.) The request has no impact on the supply of natural light and air to adjacent properties, the amount of congestion on the public streets or adjacent property values. Replacing the existing metal carport with a permanent stricture would be consistent with the character of the neighborhood. g.) The applicant's request is the minimum action required to eliminate the hardship. The width of the garage addition is 19 feet, the minimum for a two -car garage. 2. The variance shall allow a two and one -half -foot overhang on the side of the garage. 3. A building permit is required prior to constriction of the proposed improvements. Prior to issuance of a building permit, the applicant shall submit detailed building plans for the proposed improvements. 4. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 2 103 0. 06 of the Zoning Ordinance.
