HomeMy WebLinkAboutCity Council Resolution 2004-383CITY OF PLYMOUTH RESOLUTION NO. 2004-383 AUTHORIZING THE VACATION OF THAT PART OF WESTON LANE ADJACENT TO LOT 1, BLOCK 3, MAPLE CREEK 2ND ADDITION WHEREAS, a public hearing with respect to said vacation was scheduled for September 13, 2004 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of September 13, 2004; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on September 13, 2004 to inform any and all interested parties relevant to the vacation of that portion of Weston Lane as platted in Maple Creek 2nd Addition; and WHEREAS, it was determined by the City Council that said right-of-way was not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following right-of-way be vacated: That part of Weston Lane platted within Maple Creek 2" a Addition, lying south of the westerly extension of the south right-of-way line of Medina Road as platted in said plat and north of the southeasterly extension of the south property line of Lot 1, Block 3 of said plat. FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains Resolution No. 2004-383 Page 2 and hydrants thereon or there under, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
