HomeMy WebLinkAboutCity Council Resolution 2004-365CITY OF PLYMOUTH RESOLUTION 2004-365 APPROVING VARIANCE FOR SIDE YARD SETBACK TO ALLOW CONSTRUCTION OF A GARAGE ADDITION AT 1315 SHADYVIEW LANE N. (200407 1) WHEREAS, an application has been filed by Jeff and Terri Naughtin for a variance for a 10 -foot side yard setback for constriction of a garage addition at 1315 Shadyview Lane N, for property legally described as follows: Lot 8, Block 1, Pinecrest, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Jeff and Terri Naughtin for a side yard setback variance, based on the following findings: This resolution approves a variance to allow a 10 -foot side yard setback for constriction of a garage addition, in accordance with the plans and application received by the City on June 16, 2004 and August 23, 25 and 26, 2004, except as amended by this resolution. 2. The variance shall allow a one -foot overhang on the side of the garage. 3. The variance is approved with the finding that the applicable variance standards are met. Specifically: a) Although the property is large, the site topography and design of the home prevent the applicant from constricting a garage that would be consistent in size with the size of the home. The garage as proposed would preserve the architectural style of the home and maintain a setback from the street that is consistent with the neighborhood character. b) The consistently large front yard setbacks in the neighborhood are not typical of most RSF-1 properties. Resolution 2004-365 (2004071) Page 2 of 3 c) The request is not based exclusively upon a desire to increase the value or income potential of the property. It would allow the applicant to increase the living space and livability of the home. d) The conditions relating to the hardship were not created by the applicant. e) Granting the variance would result in an addition that would blend with the design of the existing home and would be in keeping with the size of the surrounding properties. f) The variance would not impair an adequate supply of light and air to adjacent property, substantially increase the congestion of the public streets, increase the danger of fire, endanger the public safety or negatively impact property values within the neighborhood. g) The proposed garage is reasonably sized and would be in keeping with the character of the surrounding properties. 4. A building permit is required prior to constriction of the proposed improvements. Prior to issuance of a building permit, the applicant shall submit detailed building plans for the proposed improvements. 5. The building materials of the addition shall match the exterior materials and color of the home. 6. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 7. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 2 103 0. 06 of the Zoning Ordinance.
