RESOLUTION 2004-363
APPROVING AN INTERIM USE PERMIT FOR UNTIEDT' S GARDEN MARKET TO
OPERATE A SEASONAL MARKET LOCATED AT 1605 COUNTY ROAD 101 (2004100)
WHEREAS, Untiedt's Garden Market has requested approval of an interim use permit to operate
a seasonal market on property legally described as follows:
Tract C, Registered Land Survey No. 1301, Files of Registrar of Title, County of
Hennepin.
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing
and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the interim use permit
for Untiedt's Garden Market to operate a seasonal market on property located at 1605 County
Road 101, subject to the following conditions:
This interim use permit is approved to allow a fall garden market sale from September 15th to
October 31st, 2004, in accordance with the application and plans received by the City on
August 2, 2004.
2. The interim use permit shall terminate on November 2, 2004.
3. Products shall be limited to produce, vegetables, flowers, and plants. Other accessory items
may be sold provided there are clearly incidental to the sale of produce, flowers, and plants.
4. The display of merchandise on unpaved landscaped areas shall be prohibited.
5. The hours of operation shall be limited to 9:00 a.m. to 7:00 p.m.

6. Signage related to this use shall be in compliance with Section 21155.03, Subd. 4 (e) (2) of
the Zoning Ordinance, as follows: 1) one (16) square foot sign has been approved for the
sales event; 2) the sign shall be setback at least ten (10) feet from lot lines, and shall not be
located in the street right of way; and 3) the sign shall be erected only during the approved
period of the sale.
