HomeMy WebLinkAboutCity Council Resolution 2004-362CITY OF PLYMOUTH RESOLUTION 2004-362 APPROVING ENCROACHMENT AGREEMENT FOR EXISTING BOULDER RETAINING WALL CONSTRUCTED ON LOT 4, BLOCK 2, SEVEN GREENS — 15810 51sT AVENUE WHEREAS, Swanson Homes on behalf of Gregory and Audrey Fresh, is requesting the City to grant approval for an existing boulder retaining wall to remain in a public drainage and utility easement on the subject property; and WHEREAS, the encroachment agreement only permits the encroachment of the boulder retaining wall within the easement and all related facilities must still meet all applicable City codes; and WHEREAS, the property is legally described as Lot 4, Block 2, Seven Greens; NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on behalf of the City of Plymouth an encroachment agreement that will allow for the existing boulder retaining wall to remain in the public drainage and utility easement on the subject property.
