HomeMy WebLinkAboutCity Council Resolution 2004-357CITY OF PLYMOUTH RESOLUTION 2004-357 APPROVING VARIANCE TO THE MINIMUM LOT WIDTH TO ALLOW A MINOR SUBDIVISION TO CREATE TWO LOTS FOR PROPERTY LOCATED AT 5780 OAKVIEW LANE NORTH (2004054) WHEREAS, an application has been filed by Boyer Palmer which requests approval of a variance to allow a new lot to be created with 41.8 feet of frontage where the 110 feet is required for property legally described as follows: Lot 6, Block 1, Palmer's Cove, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Boyer Palmer for a variance to allow a new lot to be created with 41.8 feet of frontage where the 110 feet is required for property located at 5780 Oakview Lane North, based upon the following findings and conditions: 1. This variance is granted in accordance with the plans received by the City on June 23, 2004, except as may be amended by this resolution, based on the findings that the applicable standards have been met as follows: a. The applicant has shown hardship related to the shape of the lot and its relationship to the public right-of-way. b. Granting the variance to add one single family home would not affect the character of the area nor impair an adequate supply of light and air to adjacent property, endanger the public safety, or increase the danger of fire, or endanger the public safety, or substantially diminish or impair property values within the neighborhood. In addition, the subdivision is unlikely to increase the congestion of public streets as the new single family home is Resolution 2004-357 (2004054) Page 2 estimated to create approximately 10 trips per day, which is an insignificant amount even on a small cul-de-sac. c. The request is the minimum action necessary to eliminate the hardship. 2. Separate permits are required prior to commencement of constriction. 3. No building permits shall be issued until the minor subdivision is recorded and proof of recording is received by the City. 4. A revised plan for the shared driveway shall be submitted for staff approval. The driveway shall be relocated to the north, approximately half on each of proposed parcels A and B. 5. Compliance with the City Engineer's Memorandum. 6. This approval shall expire one year after the date of approval, unless the applicant has recorded the minor subdivision or substantially started constriction of the project, or unless the applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 2 103 0. 06 of the Zoning Ordinance.
