RESOLUTION 2004-342
APPROVING A PUD AMENDMENT FOR HOM FURNITURE TO INCREASE THE SIZE
OF THE HOM FURNITURE BUILDING LOCATED AT 4150 BERKSHIRE LANE NORTH

WHEREAS, HOM Furiture has requested a Planned Unit Development (PUD) Amendment to
increase the size of the HOM Furniture building from 214,313 square feet to 261,139 square feet
for property legally described as follows:
Lot I and that part of Lot 2, Block 1, PLYMOUTH BUSINESS CENTER 6TH
ADDITION, lying easterly and northerly of the following described line:
Beginning at the most northerly corner of said Lot 2 thence southeasterly along the
northeasterly line of said Lot 2 and its southeasterly extension to the south line of the north
5 feet of said Lot 2; thence easterly along said south line to the east line of said Lot 2 and
there said line terminates.
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by HOM
Furniture, subject to the following conditions:
1. A PUD amendment is approved to increase the size of the building from 214,313 square feet
to 261,139 square feet by adding a second level mezzanine above the existing warehouse and
lease spaces in the north portion of the building, in accordance with the plans received by the
City on July 29, 2004, except as may be amended by this resolution.
2. With the exception of the increased building size for fiirniture showroom space and warehouse
space, all other conditions of Resolution 2001-268 shall remain in force.

3. Prior to issuance of the building permit needed to occupy the mezzanine area, the applicant
shall submit a final landscaping plan, as approved by the City Forester, and a Site
Improvement Performance Agreement and financial guarantee for the required additional
trees.
