TO ALLOW INSTALLATION OF GROUND EQUIPMENT ACCESSORY TO AN EXISTNG TELECOMM[_]NICATION TOWER IN THE FORESTVIEW LANE RIGHT-OF-WAY AT THE NORTHWEST CORNER OF THE INTERSECTION OF FORESTVIEW LANE AND RIDGEMONT AVENUE. (2004074) WHEREAS, Carlson and Harrington, Inc., on behalf of Sprint PCS. has requested a conditional use permit to allow installation of ground equipment in cabinets accessory to an existing telecommunication tower in the Forestview Lane Right -of -Way on property legally described as follows: Brookview Drive, now known as Forestview Lane, as dedicated on the plat of Sunrise Acres; according to the recorded plat therof Hennepin County, Minnesota. Described as follows: Commencing at the southwest corner of Lot 13, Block 2 of said Sunrise Acres; thence north, assumed bearing along the west line of said Lot 13, a distance of 39.40 feet; thence west, a distance of 55.23 feet to the point of beginning of the Leased Premises Site to be described: thence south, a distance of 13.00 feet; thence west, a distance of 3.00 feet; thence north, a distance of 13.00 feet; thence east, a distance of 3.00 feet to the point of beginning. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing, and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Carlson and Harrington, Inc. for a conditional use permit, subject to the following conditions: Resolution 2004-317 (2004074) Page 2 1. A conditional use permit is approved to allow installation of ground equipment in cabinets, as shown on the application and plans received by the City on June 17, 2004, based on the findings that the applicable general and measurable standards as listed in the Zoning Ordinance have been met, except as may be amended by this resolution. 2. Standard Conditions: A. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. B. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. C. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
