RESOLUTION 2004-315
APPROVING A SITE PLAN AMENDMENT AND VARIANCES FOR WILLOW
WOODS ESTATES LOCATED AT 10810 SOUTH SHORE DRIVE. (2004068)
WHEREAS, Dominium Development & Acquisition, LLC. is requesting approval of a site plan
amendment and variances to allow the constriction of a community room, rehabilitation of the
existing units, and additional parking spaces for Willow Woods Estates on property legally
described as:
That part of the south 15 acres of the northwest quarter of the northwest quarter of
Section 36, Township 118, Range 22, Hennepin County, Minnesota described as follows:
Commencing at the northeast corner of Tract A, Registered Land Survey No. 694; thence
northeasterly along the centerline of South Shore Drive a distance of 268.00 feet to the
actual point of beginning; thence northwesterly at right angles 200.00 feet; thence
southwesterly to a point in the northerly extension of the west line of said Tract A distant
114.48 feet north from the northwest corner thereof, thence south to the southwest corner
of said Tract A; thence west to the southwest corner of the south 15 acres of the
northwest quarter of the northwest quarter; thence north to the northwest corner of said
south 15 acres; thence east along the north line thereof to the centerline of South Shore
Drive; thence southwesterly to the point of beginning; except the road.
The Registered portion of which is described as follows:
That tract of land lying westerly of the westerly line of Registered Land Survey No. 694
and its northerly extension as follows:

That part of the south 15 acres of the northwest quarter of the northwest quarter of
Section 36, Township 118, Range 22, lying southerly of a line drawn equidistant between
the north and south line of said south 15 acres to the US Government Survey thereof.
Together with the east 30.00 feet of the south 497.00 feet, as measured at right angles to
the east and south lines, of the northeast quarter of the northeast quarter of Section 35,
Township 118, Range 22, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Dominium Development & Acquisition, LLC., for a site plan amendment and variances for
Willow Woods Estates located at 10810 South Shore Drive, subject to the following conditions:
1. A site plan amendment is approved to allow constriction of a community building and
additional parking spaces, in accordance with the plans received by the City on June 15, 2004,
except as amended by this resolution.
2. Variances are approved as follow: 1) to allow the side -yard setback reduced to 19.78 feet for
Building 2, 18.14 feet for Building 4, 20.27 feet for Building 5 and 17.74 feet for Building 6
instead of the required 25 feet; and 2) to allow the community room addition to be six feet
from the existing drive aisle instead of 10 feet as required by ordinance, in accordance with
the plans received by the City on June 15, 2004, based on the findings that the applicable
variance standards have been met.
3. Prior to issuance of a building permit, the applicant shall revise the plans to include the
number, specie, size and location of trees planted to screen the new parking spaces to
demonstrate the screening proposed is in conformance with Zoning Ordinance requirements.
4. Prior to issuance of a building permit, the applicant shall revise the plans to include
photometry and fixture details demonstrating the new parking areas are in compliance with
Zoning Ordinance requirements.
5. Prior to issuance of a building permit, the applicant shall provide a financial guarantee and Site
Improvement Performance Agreement for all site improvements.
6. A separate building permit is required prior to commencement of the project.
7. The applicant shall comply with the City Engineer's Memorandum.

8. Approval shall expire one year after the date of approval, unless the property owner or
applicant has substantially started constriction of the project. The landowner or applicant may
apply for approval of an extension by the City, as regulated under Sections 21030.06
21045.09 of the Zoning Ordinance.
