HomeMy WebLinkAboutCity Council Resolution 2004-313CITY OF PLYMOUTH RESOLUTION 2004-313 APPROVING A SITE PLAN AMENDMENT AND CONDITIONAL USE PERMIT TO ALLOW A COLD -STORAGE BUILDING IN THE MAINTENANCE COMPLEX AT CLIFTON E. FRENCH REGIONAL PARK AT 12655 COUNTY ROAD 9 (2004065) WHEREAS, Three Rivers Park District has requested approval of a site plan amendment and conditional use permit to constrict a cold -storage building and related improvements in the maintenance complex at Clifton E. French Regional Park on property legally described as follows: That part of the southwest quarter of the northwest quarter, described as beginning at the southwest corner thereof, thence on an assumed bearing of north 0 degrees, 18 minutes, 5 seconds west along the west line thereof 374.13 feet thence north 60 degrees, 19 minutes, 41 seconds east 506.51 feet thence northeasterly along a tangential curve concave to the southeast, having a radius of 4,545.66 feet a distance of 215.4 feet, thence southeasterly to a point on the east line of the west 867 feet of the southwest quarter of the northwest quarter a distance of 255 north from the south line thereof, thence south along said east line to the south line thereof, thence west to the beginning except roads, all located in Section 14, Township 118, Range 22, Hennepin County. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Three Rivers Park District to allow the installation of a cold -storage building and related improvements in Clifton E. French Regional Park at 12655 County Road 9, subject to the following conditions: 1. A site plan amendment is approved to allow a 3,528 square -foot, cold -storage building and related improvements, in accordance with the plans received by the City on June 10, 2004, except as may be amended by this resolution. A conditional use permit is approved to allow constriction of a second principal building within the maintenance complex, based on the findings that the applicable standards in Section 21015 have been met. Specifically, that the additional building is in compliance with the Comprehensive Plan, would not have a detrimental effect on adjacent properties or the public welfare, would require no additional public facilities and adheres to the P -I district regulations. 3. Separate building permits are required prior to the commencement of any constriction related to the project. 4. All signage and fencing shall comply with the Zoning Ordinance. 5. Prior to the issuance of any permits, the landscaping plan shall be revised to show four additional trees planted on the site in conformance with the Zoning Ordinance. 6. Prior to the issuance of any permits, the plans shall be revised to incorporate a 26 -foot drive aisle between the two rows of parking spaces. 7. Prior to the issuance of any permits, the applicant shall provide fixture details and a lighting plan in conformance with the ordinance for the security lights proposed over the fuel pumps. 8. No additional lighting will be required as part of this request. 9. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Prior to issuance of any permits, the applicant shall submit a Site Improvements Performance Agreement and the related financial guarantees. c. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. d. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. e. Prior to issuance of a building permit, the fire apparatus access road signage and locations must be identified on the site plan. f. Prior to issuance of a building permit, the plans shall be revised incorporating the required showing the required 45 -foot inside turning radius from all directions on the fire apparatus access roads. g. A city -approved, monitored, automatic fire -sprinkler system is required to protect the entire building. h. Prior to issuance of a building permit, the plans shall be revised to identify the approved locations of the Fire Department connection in the southeast corner of the building and the Fire Department lockbox on the building exterior. i. An approved solenoid device is required on a combination fire and domestic water supply line to the building. Resolution 2004-313 (2004065) Page 3 j. An approved address/street name sign is required in an approved location at the intersection of the new entrance to the maintenance complex. k. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21015.07 of the Zoning Ordinance.
