RESOLUTION 2004-308
APPROVING SITE PLAN, CONDITIONAL USE PERMITS, AND VARIANCES FOR
MOHAGEN/HANSEN ARCHITECTURAL GROUP FOR "PLYMOUTH OFFICE PLAZA",
LOCATED SOUTH OF OLD ROCKFORD ROAD AND WEST OF PEONY LANE (200405 1)
WHEREAS, Mohagen/Hansen Architectural Group has requested approval of a site plan,
conditional use permits, and variances to allow constriction of an 11 -unit town office
condominium development in three buildings on a 3.64 -acre site presently legally described as
follows:
That part of the Southeast quarter of Section 7, Township 118, Range 22 which lies South of
County Road No. 9, except that portion platted in Osier Addition; and that part of the West
half of the Northwest quarter of the Northeast quarter of Section 18, Township 118, Range
22 which lies Northeasterly of Osier Addition, except that part lying within County Road No.
9, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Mohagen/Hansen Architectural Group for a site plan, conditional use permits, and variances for
an 11 -unit town office condominium development in three buildings located south of Old
Rockford Road and west of Peony Lane, subject to the following findings and conditions:
1. Approval of the site plan, conditional use permits, and variances are contingent upon City
approval of the preliminary plat.
2. A site plan is approved in accordance with the plans received by the City on June 15, 2004,
except as may be amended by this Resolution.

3. A conditional use permit is approved to allow two principal buildings on Lot 1, Block 2 of
the site.
4. A conditional use permit is approved to allow roughly 10.2 percent of the gross building area
to be used for indoor warehousing within the designated garage areas, provided that any such
warehousing shall be accessory to a permitted use in the B -C district.
5. No outside storage is allowed on the site.
6. No medical/medical office uses (including dental and chiropractic uses) shall be permitted in
any unit within the development.
7. A variance is approved to allow a building setback of 50 feet from the south lot line, based
upon the finding that the applicable variance standards have been met.
8. A variance is approved to allow a building setback of 25 feet from the 45th Avenue right-of-
way for the northernmost building on Block 2, based upon the finding that the applicable
variance standards have been met.
9. Development standards shall be as required by the B -C district. No variances are granted or
implied, unless specifically noted in this resolution.
10. Any signage shall require separate permits and shall be in conformance with the Zoning
Ordinance.
11. Prior to issuance of any building permits, the applicant shall pay all required park dedication
fees.
12. Prior to the issuance of building permits„ the applicant shall provide the City with a copy of
the CIC (Common Interest Community) documents and any other related association
documents for the development. The documents shall address maintenance of the common
areas and the prohibition of medical uses within the project based on the City's parking
requirement.
13. Prior to issuance of any building permits, the applicant shall provide a revised landscape plan
showing a hedge row around the parking areas in a manner that provides year-round
screening of the parking areas from the neighboring residential areas. The landscape plan
shall also be revised o substitute 10 evergreen trees for 10 of the maple trees shown in the
front yard abutting Old Rockford Road.
14. Prior to issuance of any building permits, the applicant shall provide a revised site plan
showing an additional dumpster enclosure (or interior trash room) within Block 2 of the
development. The dumpster enclosure shown within Block 1 shall remain as presently
shown.

15. All waste and waste containers shall be stored within an enclosure stricture or in an interior
trash room.
16. The signage on the building facades shall consist of individual metal letters within the
designated signboard area (above the doorways) and shall not be back lit. The freestanding
monument sign located near the site entrance shall be constricted of pre -finished metal
placed upon a brick base. Only the letters for the freestanding sign shall be translucent and
lit from an internal light source. The freestanding sign shall be oriented at a right angle to
Old Rockford Road so it does not face directly towards the residential area north of that road.
17. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
c. No building permits shall be issued until the Site Improvement Performance Agreement
and has been executed and the required financial guarantees submitted.
d. The applicant shall comply with the Ordinance regarding the location of fire hydrants,
lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane
signage.
e. Prior to issuance of building permits, the applicant shall submit fire flow calculations.
f. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release
or reduction of any site improvement financial guarantees per City Ordinance.
g. This approval shall expire one year after the date of approval, unless the property owner
or applicant has substantially started constriction of the project or unless the landowner
or applicant has received prior approval from the City to extend the expiration date for up
to one additional year, as regulated under Sections 21015.07, 21030.06, and 21045.09 of
the Zoning Ordinance.
