RESOLUTION 2004-293
APPROVING ENCROACHMENT AGREEMENT FOR
RETAINING WALL CONSTRUCTION AT
1072035 TH AVENUE NORTH
WHEREAS, David and Bonnie Guerre have requested approval to execute an encroachment
agreement to constrict a retaining wall within the right-of-way and a public drainage and utility
easement; and;
WHEREAS, the encroachment agreement only permits the encroachment of the retaining wall
within the right-of-way and the public drainage and utility easement, and all related facilities must
still meet all applicable City codes; and
WHEREAS, the property is legally described as Lot 14, Block 1, Armstrong Ridge;
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on
behalf of the City of Plymouth an encroachment agreement that will allow for the constriction of a
retaining wall at 10720 35th Place.
