HomeMy WebLinkAboutCity Council Resolution 2004-284CITY OF PLYMOUTH RESOLUTION 2004-284 APPROVING A VARIANCE FOR BRADLEY & DIANE HESSLUND FOR PROPERTY LOCATED AT 3220 PINEVIEW LANE NORTH (2004060) WHEREAS, an application has been filed by Bradley and Diane Hesslund which requests approval of a variance for an impervious surface coverage of 29.7 percent to allow constriction of a 14 -foot by 14 -foot screened porch for property legally described as follows: Lot 9, Block 3, Heritage Ridge Plat Two, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Bradley and Diane Hesslund for an impervious surface coverage variance to allow constriction of a 14 - foot by 14 -foot screened porch at 3220 Pineview Lane North, subject to the following conditions: 1. This resolution approves a variance to allow an impervious surface coverage of 29.7 percent, in accordance with the application and plans received by the City on June 3, 2004, except as may be amended by this resolution. 2. The variance is approved with the findings that the applicable variance standards are met, as follows: a) The lot, at 11,936 square feet, is smaller than the minimum lot size of 12,500 square feet specified for the RSF-2 zoning district, and is one of the smallest lots in the Heritage Ridge Plat Two Subdivision. All of the surrounding lots are larger. Due to the relatively small size of this lot, the applicants would not be allowed add any additional impervious surface under the strict letter of the regulations. Resolution 2004-284 (2004060) Page 2 of 3 b) The conditions are somewhat unique in that this lot is smaller than the minimum lot size required in the RSF-2 zoning district. The applicants are requesting an impervious surface coverage of 29.7 percent, which was allowable at the time the lot was approved and developed. c) The request is not based upon a desire to increase value or income potential of the property. The applicants state that the proposed screened porch would improve livability of their property by allowing them to enjoy of their back yard without insects. d) The conditions were not created by the applicant, but rather are created by the platting of the lot, the design of the home, and the changes that occurred to the shoreland regulations after the home was occupied. The applicants had no control over any of those factors. e) Granting the variance would not affect the water quality of Medicine Lake because the storm water runoff from this site is treated in an existing water quality pond prior to reaching the lake. Additionally, the proposed screened porch would not detract from the appearance of the home or surrounding properties. f) The proposed screen porch would not impair an adequate supply of light and air to adjacent property, nor would it substantially increase the congestion of the public streets, increase the danger of fire, endanger the public safety, or substantially impair property values within the neighborhood. g) The requested variance is the minimum action required to eliminate the hardship. 3. Any changes or fi ture expansions are subject to required reviews and approvals per Ordinance provisions. 4. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 2 103 0. 06 of the Zoning Ordinance.
