HomeMy WebLinkAboutCity Council Resolution 2004-283CITY OF PLYMOUTH RESOLUTION 2004-283 APPROVING CONDITIONAL USE PERMIT TO ALLOW INSTALLATION OF A MONOPOLE ANTENNA TOWER AND RELATED GROUND EQUIPMENT FOR VOICESTREAM MINNEAPOLIS, INC. D/B/A T -MOBILE IN THE FORESTVIEW LANE RIGHT-OF-WAY LOCATED SOUTH OF HIGHWAY 55 (2004053) WHEREAS, VoiceStream Minneapolis, Inc. d/b/a T -Mobile has requested approval of a conditional use permit for a 75 -foot high monopole tower to be located in the Forestview Lane right-of-way located roughly 725 feet south of the South Highway 55 Service Road; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by VoiceStream Minneapolis, Inc. d/b/a T -Mobile for a conditional use permit, subject to the following conditions: 1. This approval allows a 75 -foot high monopole antenna tower, related ground equipment, and screen fence enclosure pursuant to the application and plans received by the City on May 17, 2004. 2. The conditional use permit is granted with the finding that the proposal: 1) would be consistent with the Comprehensive Plan; 2) would not be detrimental to the public health, safety, morals or comfort because the antennas would comply with all State and Federal Communication requirements; 3) would not be injurious to the use and enjoyment of other property in the area for the uses already permitted, nor substantially diminish or impair property values within the neighborhood; and 4) would not impede the development or improvement of surrounding properties. Resolution 2004- (2004053) Page 2 3. Prior to installation of the monopole and related equipment, the applicant must obtain a City permit to allow constriction within the right-of-way. 4. An encroachment agreement acceptable to the City must be executed prior to issuance of the City permit referred to in Item No. 3 of this resolution. The monopole and related equipment shall comply with the terms of such encroachment agreement. 5. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 6. The monopole shall be painted a light color (e.g., silver or light blue) or shall have a galvanized finish. 7. The monopole shall be designed to accommodate one other wireless user. 8. The conditional use permit shall expire one-year from the date of approval, unless the project is substantially completed or an extension is applied for and granted, as regulated under Section 21015.07 of the Zoning Ordinance.
