HomeMy WebLinkAboutCity Council Resolution 2004-282CITY OF PLYMOUTH RESOLUTION 2004-282 APPROVING A CONDITIONAL USE PERMIT FOR SALES AND RENTAL OF SKID -LOADERS IN THE I-2 (GENERAL INDUSTRIAL) DISTRICT FOR PROPERTY LOCATED AT 5505 STATE HIGHWAY 169. (2004047) WHEREAS, Top Notch Equipment has requested approval of a conditional use permit to allow sales and rental of skid -loaders in the I-2 (General Industrial) district for property legally described as follows: The south 820 feet of east 485 feet of southeast quarter of southeast quarter except highway frontage road section 1, township 118, range 22, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Top Notch Equipment for a conditional use permit to allow sales and rental of skid -loaders in the I-2 (General Industrial) district for property located at 5505 State Highway 169, subject to the following conditions: 1. The conditional use permit allows the sales and rental of skid -loaders in the I-2 (General Industrial) district for property located at 5505 State Highway 169, in accordance with the application and plans received by the City on May 5, 2004, except as amended by this resolution. 2. The conditional use permit is approved with the finding that all applicable conditional use permit standards are met, as follows: a. the proposed use at this location would comply with the Comprehensive Plan; b. the proposed use would not be detrimental to, or endanger the public health, safety, morals, or comfort; c. the proposed use would not be injurious to the surrounding properties or to the City as a whole; d. the proposed use would not impede the orderly development of the district; e. the site is adequately served by public facilities; f. the use would comply with the regulations of the I-2 zoning district; and the use would not affect the parking required for the uses on site. The skid -loaders shall be parked in compliance with the parking setback requirements of Section 21135 of the Zoning Ordinance. 3-4.The applicant shall stripe the unmarked parking area at the front of the building to comply with the parking standards in Section 21135 of the Zoning Ordinance. 45. Standard Conditions: a. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. b. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has commenced the use, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
