HomeMy WebLinkAboutCity Council Resolution 2004-270CITY OF PLYMOUTH RESOLUTION 2004-270 APPROVING ENCROACHMENT AGREEMENT FOR CONSTRUCTION OF A FENCE AT 3110 NATHAN LANE WHEREAS, Jeffery A. Hansen has requested approval to execute an encroachment agreement to constrict a fence; and; WHEREAS, the encroachment agreement only permits the encroachment of the fence within the easement and all related facilities must still meet all applicable City codes; and WHEREAS, access shall be maintained by routing the trail around the manhole and control stricture and providing gates in the fence; and WHEREAS, the property is legally described as Lot 2, Block 1, SUNRISE MARSH; NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on behalf of the City of Plymouth an encroachment agreement that will allow for the constriction of a fence within a sanitary sewer, drainage and utility easement along the public trail located at 3110 Nathan Lane.
