RESOLUTION 2004-263
APPROVING A SITE PLAN AMENDMENT FOR A LOADING AREA AND SITE
IMPROVEMENTS FOR THE PROPERTY AT 10205 51ST AVENUE N. (2004048)
WHEREAS, Taher, Inc., is requesting approval of a site plan amendment for a loading area and
related site improvements for the property at 10205 51" Avenue N., for property legally described
as:
Lot 3, Block 1, Ryan Business Center, Hennepin County, Minnesota
WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Taher,
Inc, for a site plan amendment for property located at 10205 51" Avenue North, subject to the
following conditions:
1. A site plan amendment is approved to allow constriction of a loading area and related site
improvements, in accordance with the plans received by the City on May 11, 2004, except as
amended by this resolution.
2. Prior to issuance of a building permit, the applicant shall obtain approval of an administrative
permit to allow outside storage of the delivery vans.
3. Prior to issuance of a building permit, the applicant shall provide a financial guarantee and Site
Improvement Performance Agreement for all site improvements.

4. A separate building permit is required for the screening wall. The wall shall be designed by a
Structural Engineer.
5. The applicant shall comply with the City Engineer's Memorandum.
6. Approval shall expire one year after the date of approval, unless the property owner or
applicant has substantially started constriction of the project. The landowner or applicant may
apply for approval of an extension by the City, as regulated under Section 21045.09 of the
Zoning Ordinance.
