RESOLUTION No. 2012-045
A RESOLUTION REQUESTING
PAYMENT NUMBER 5 AND FINAL
PLYMOUTH CREEK STREAM BANK RESTORATION
CITY PROJECT NO. 8128
WHEREAS, the City of Plymouth as owner and Sunram Constriction, Inc. as contractor,
have entered into an agreement for the Plymouth Creek Stream Bank Restoration Project, City
Project No. 8128, and said agreement was approved by the City Council on December 14, 2010;
and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $666,664.13. The work to date is
$704,920.82 and is approved. This project is more than the original contract
amount by $38,254.69 or 5.7% due to two change orders for tree removal and
additional excavated materials.
2. The work performed by the contractor for the Plymouth Creek Stream
Restoration Project No. 8128 and certified to the Council by the engineer as
acceptable, being the same, is hereby released from the contract except as to the
conditions of the performance bond, any and all legal rights of the owner,
required guarantees and correction of faulty work after final payment.
3. Request for Payment No. 5 and Final in the amount of $39,850.09 to Sunram
Constriction, Inc. for the Plymouth Creek Stream Bank Restoration Project,
City Project No. 8128, is hereby approved and the City's Administrative
Services Director is hereby authorized and directed to pay the same forthwith
from the Water Resources Fund.
