HomeMy WebLinkAboutCity Council Resolution 2004-260CITY OF PLYMOUTH RESOLUTION 2004-260 APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR RYLAND HOMES, INC. FOR "THE FIELDS OF NANTERRE, THIRD ADDITION" LOCATED NEAR THE INTERSECTION OF YUMA LANE AND SCHMIDT LAKE ROAD (2001148F) WHEREAS, The Ryland Group has requested approval of a final plat and development contract for "The Fields of Nanterre, Third Addition", a re -plat of 40 townhouse lots and two common open -space lots on roughly 7.598 acres located near the intersection of Yuma Lane and Schmidt Lake Road; and WHEREAS, the property is legally described as follows: Lots 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, and 31, Block 2, And Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, and 35, Block 3, The Fields of Nanterre, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Ryland Homes for a final plat and development contract for The Fields of Nanterre, Third Addition; and, FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. Approval of the final plat is contingent on the applicant executing the Development Contract and recording the vacation of drainage and utility easements. Resolution 2004-260 (2001148F) Page 2 2. This final plat approves the reorientation of 40 townhouse lots and two common open -space lots, in accordance with the plans received by the City on June 24, 2004 and May 14, 2004, except as amended by this Resolution. 3. Prior to recording the final plat, the applicant shall submit the required easements as specified in the Engineer's Memo and as approved by the City Engineer. 4. Homeowner Association documents, covenants and restrictions shall be filed with the Final Plat. Proof of recording shall be furnished to the City. 5. All signage shall comply with the Sign Ordinance. No variances are granted or implied. 6. Development standards shall be as required by the RMF -2 district. No variances are granted or implied. 7. All sidewalks internal to the development shall be privately maintained. 8. All buildings in the development shall be protected by a City approved NFPA 13D automatic fire sprinkler system approved by the City. 9. A fence, not exceeding six feet in height, shall be provided for privacy and screening in the front yard along Schmidt Lake Road as shown on the landscape plan. The fence shall be owned and maintained by the homeowners association. 10. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Park dedication was previously satisfied for this property. c. No building permits shall be issued until a contract has been awarded for sewer and water and issued. d. No building permits shall be issued until the final plat and the vacation or easements are filed and recorded with Hennepin County. e. Prior to the issuance of permits, fire flow calculations in conformance with City ordinances and policies shall be submitted. f. Compliance with the City Code regarding the location of fire hydrants and fire lane signage. g. Street names shall comply with the City Street Naming System. h. Removal of all hazardous trees from the property at the owner's expense. i. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility.
