HomeMy WebLinkAboutCity Council Resolution 2004-255CITY OF PLYMOUTH RESOLUTION 2004-255 APPROVING A LAND USE GUIDE PLAN AMENDMENT FOR CSM CORPORATION FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER OF HIGHWAY 55 AND VICKSBURG LANE (2004024) WHEREAS, CSM Corporation has requested reclassification of the land use guiding of the 28.7 - acre site located at the southwest corner of Highway 55 and Vicksburg Lane from IP (Planned Industrial) to C (Commercial) for 23.6 acres and to LA -4 (Living Area 4) for 5.1 acres in the south portion of the site; and, WHEREAS, the property affected by the amendment is presently legally described as Lot 1, Block 1, Spicer Addition, Hennepin County, Minnesota; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by CSM Corporation for reclassification of the land use guiding from IP (Planned Industrial) to C (Commercial) and to LA -4 (Living Area 4) for the 28.7 -acre parcel of land located at the southwest corner of Highway 55 and Vicksburg Lane, based on the following findings: I. The site meets the location criteria for C and LA -4 guiding because 1) it is located at the intersection of two arterial roadways, 2) a land use transition (the LA -4 area and existing natural features) would provide a buffer between the commercial area and the existing single- family neighborhood to the south, and 3) the LA -4 area would be located close to permanent open space (the large wetland basin) and shopping facilities, and would be in reasonable proximity to jobs. 2. The site is better suited for the proposed development than for industrial development because the adjacent single-family neighborhood to the south is not an intensive land use. The close proximity to other existing commercial development in the area indicates that the proposed commercial area is well positioned for retail/commercial development. Additionally, the site's location at the intersection of two major roadways makes it highly visible in the community. That attribute is not required for industrial developments but is more closely associated with, and generally required for the proposed retail use of the site. Resolution 2004-255 (2004024) Page 2 3. The parcel size, location, underutilized and vacant status, and market demand supports a re- examination of the guiding of this site. 4. Reguiding of this 28.7 -acre site would not adversely affect the industrial land supply. There are no remaining locations in the community that could accommodate the proposed uses without reguiding and/or redevelopment. 5. The proposed redevelopment project would enhance convenience to Plymouth residents, and would strengthen economic vitality by providing a more diverse tax base and more shopping options. 6. The proposal would not have any negative fiscal impacts on the City, and would provide more balance between the commercial and industrial tax bases, helping to diversify the City's economic base. 7. The proposal would not result in negative impacts on infrastructure, assuming constriction of the traffic improvements proposed in conjunction with the redevelopment. Furthermore, the project could speed up the timing of intersection improvements that otherwise may not occur until well into the future. 8. The proposed LA -4 area in the southern portion of the site is suitable for LA -4 guiding if appropriate transitions are provided. The LA -4 area would not be suitable for owner - occupied townhomes in multiple strictures, because such a development would be spread out over most of the LA -4 area, limiting the opportunity to provide screening between the LA -4 area and the commercial area to the north. However, the proposed LA -4 area could be suitable for other LA -4 uses such as apartment -style housing or a daycare center with a design that provides both adequate area to screen around the perimeter of the site and outdoor spaces that are separated from the commercial area. FURTHER, approval of the land use guide plan amendment is contingent upon, and subject to, the required review and response by the Metropolitan Council. ADOPTED by the City Council on June 28, 2004.
