HomeMy WebLinkAboutCity Council Resolution 2004-252CITY OF PLYMOUTH RESOLUTION 2004-252 APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR PHASE I OF "WYNFIELD PLACE" FOR DEAN JOHNSON HOMES FOR PROPERTY LOCATED WEST OF NORTHWEST BOULEVARD (COUNTY ROAD 61) AND NORTH OF WEST MEDICINE LAKE DRIVE. (2003081F) WHEREAS, Dean Johnson Homes has requested approval of a final plat for Phase 1 of Wynfield Place, to allow the creation of 19 lots for 56 townhouses and 6 single-family homes on the 15.42 - acre site located West of Northwest Boulevard (County Road 61) and North of West Medicine Lake Drive, and; WHEREAS, the property is legally described as follows: The southerly 360 feet of that part of the Northwest Quarter of the Southeast Quarter of Section 10, Townhip 118, Range 22, lying between the North 232 feet and the South 233 feet of said Quarter -quarter, EXCEPT that part thereof lying southerly of the centerline of the town road running in a northwesterly direction across the above described parcel of land. n The East 583.4 feet of that part of the Northwest Quarter of the Southeast Quarter of Section 10, Township 118, Range 22, lying between the North 232 feet and the South 233 feet of said Quarter -quarter, and lying easterly of the centerline of the town road, EXCEPT the South 360 feet (measured from the North line of said South 233 feet of said Quarter -quarter) of said Quarter -quarter. n That part of the Northwest Quarter of the Southeast Quarter of Section 10, Township 118, Range 22, lying between the North 232 feet and the South 233 feet of said Quarter- Resolution 2004-252 (2003081F) Page 2 quarter and lying east of the centerline of the town road and west of the East 583.4 feet of said Quarter -quarter. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Dean Johnson Homes for a final plat for Wynfield Place; and FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. Approval of the final plat is contingent on the applicant executing the Development Contract and recording the vacation of West Medicine Lake Drive. 2. This final plat approves 19 lots including 6 lots for single-family dwellings, 8 lots for 56 townhouse dwellings, four common area lots and one outlot for fiiture development in accordance with the plans received by the City on May 28, 2004 and March 16, 2004, except as may be amended by this Resolution. 3. Prior to recording the final plat, the applicant shall provide the average buffer width around the wetland on the east side of the development and/or make adjustments as necessary. 4. Prior to recording the final plat, the applicant shall pay park dedication in lieu of land dedication for all the units shown on the plans. 5. Prior to recording the final plat, the applicant shall submit a trail easement adjacent to Northwest Boulevard across the entire property as specified in the Engineer's Memo. 6. Prior to recording the final plat, a pond maintenance agreement is required between the developer and the City for the water quality ponds. 7. Prior to recording the final plat, the applicant shall revise the homeowner association documents to include language that prohibits decks or three -season porch conversions in violation of City Ordinances and notes specifically which lots would not be allowed decks and patios. 8. Prior to issuance of any building or grading permits, the applicant shall revise the tree preservation plan to clarify the removal status of several trees shown to be saved, but located Resolution 2004-252 (2003081F) Page 3 within proposed grading contours, including trees numbered: 367, 311-314, and 328-333. The reforestation/restitution figures shall be revised as necessary. 9. Prior to issuance of any building permits, the applicant shall revise the landscaping plan to 1) screen the property from the north from the guest parking spaces; 2) remove the trees shown on the adjacent properties to the south (across 47t11 Avenue North) with the exception of those trees and shrubs shown on the public right-of-way or on private property within the Curtis Lake Second Addition to screen the adjacent homes from headlights; 3) modify the plantings as necessary to allow maintenance vehicles to access the ponds. The restitution/reforestation calculation shall also be revised and any additional inches required shall be added to the landscaping plan. 10. Prior to issuance of any building or grading permits, the applicant shall install the required tree preservation fencing in conformance with the plans and City Code and provide the required financial guarantees. 11. Prior to issuance of building permits, the applicant must install the required permanent wetland buffer monuments in compliance with Ordinance requirements. 12. Prior to issuance of building permits, the applicant must install a sign which informs fiiture residents that Underwood Lane is a temporary cul-de-sac and that the road will ultimately be extended to Schmidt Lake Road. 13. Prior to issuance of any building permits, the applicant shall submit the marketing materials for the project, which must include the following information: 1) the lot and block number of units which do not qualify for optional decks, porches, patios or similar features; and 2) Underwood Lane North will be extended to Schmidt Lake Road when the adjacent property develops. 14. Prior to issuance of any building permits, the applicant shall submit a lighting plan showing all lighting proposed on private property in conformance with the Zoning Ordinance. 15. The applicant is encouraged to work with staff to make a portion of the development accessible to first-time homebuyers. 16. The HOA shall be responsible for maintenance of the private drives, sidewalks, boulevard plantings wetland buffers, mailboxes, monument signs and association common areas within this development. 17. Development standards shall be as required by the RMF -2 districts. No variances are granted or implied. 18. No access to Northwest Boulevard shall be permitted. Resolution 2004-252 (2003081F) Page 4 19. Standards Conditions: a. Compliance with the City Engineer's Memorandum. b. Prior to recording the final plat, the applicant is eligible for one building permit per existing legal parcel. c. No building permits shall be issued until a contract for sewer and water has been awarded. d. Removal of all hazardous trees from the property at the owner's expense. e. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. f. Signs shall require separate permits prior to installation. g. Prior to issuance of any permits, the applicant shall show the temporary access road/water supply policy on the plans. h. All strictures shall be protected by a City approved automatic fire sprinkler system and monitored as required. i. An 8'/z by I I -inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any financial guarantees. j. Prior to the issuance of any permits the applicant shall revise plans as necessary to add and relocate hydrants to approved locations, identify the domestic size of the combination fire/domestic water supply line; supply a PIV valve lockbox and Siamese connection (if required); and show fire lane, address and directional signs in approved locations. k. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility.
