HomeMy WebLinkAboutCity Council Resolution 2004-250CITY OF PLYMOUTH RESOLUTION 2004-250 APPROVING FINDINGS OF FACT FOR AMENDING THE ZONING ORDINANCE TEXT FOR HANS HAGEN HOMES FOR PLYMOUTH STATION, LOCATED SOUTHEAST OF HIGHWAY 55 AND COUNTY ROAD 24 (2004032) WHEREAS, Hans Hagen Homes has requested a Planned Unit Development (PUD) Amendment to allow certain temporary outdoor events and sales for property legally described as follows: Lots 1 and 2, Block 1, Plymouth Station, Hennepin County, Minnesota WHEREAS, the Plymouth Zoning Ordinance requires a text amendment for a PUD Amendment; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance amending the Zoning Ordinance text for Hans Hagen Homes for the Plymouth Station PUD. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Hans Hagen Homes for a PUD amendment and related Zoning Ordinance text amendment, based on the following findings: 1. The proposal would be consistent with the objectives of the Comprehensive Plan and with the commercial guiding of the site. More specifically, staff finds that temporary outdoor sales are a typical adjunct activity in commercially -guided areas and in fact are allowed in all other commercial districts in the City. 2. The proposed amendment would not affect the purpose or intent of the PUD, which was established to provide for a commercial shopping center on the site. In addition, the Resolution 2004- (2004032) Page 2 amendment would not affect the purpose of Condition No. 7 of the resolution, which was intended to provide an orderly development by prohibiting permanent outside storage and display of merchandise on the site. Furthermore, such temporary uses would be prohibited in the southerly 350 feet of the PUD and existing buildings, berming and landscaping would screen such uses from the residential area to the south.
