RESOLUTION 2004-243
APPROVING ENCROACHMENT AGREEMENT FOR
CONCRETE POOL DECK SLAB CONSTRUCTION AT
1341037 TH AVENUE NORTH
WHEREAS, Dean and Reesa Shiff have requested approval to execute an encroachment agreement
to constrict a portion of the concrete slab associated with the placement of an outdoor pool within a
drainage and utility easement; and;
WHEREAS, the encroachment agreement only permits the encroachment of the concrete slab
within the easement and all related facilities must still meet all applicable City codes; and
WHEREAS, the property is legally described as Lot 1, Block 1, Heritage West 2nd Addition;
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on
behalf of the City of Plymouth an encroachment agreement that will allow for the constriction of
that portion of the concrete pool deck slab within a drainage and utility easement along the north
side of the property located at 13410 37th Ave. N.
