RESOLUTION NO. 2004-241
APPROVING WETLAND MITIGATION AND REPLACEMENT PLAN
CANDLEWOOD PROJECT (98106)

WHEREAS, the developer(s) of Homestead Village Extended Stay Hotel have filled wetlands for
the constriction of an extended stay hotel development and provided a financial guarantee to
ensure constriction of mitigation for the wetland impacts; and
WHEREAS, the required wetland mitigation has not been created for the project; and
WHEREAS, this project now under a new ownership is proposing to take over the project; and
WHEREAS, the most effective way to provide the required wetland mitigation is through onsite
wetland mitigation, and
WHEREAS, a new onsite wetland replacement application has been prepared and reviewed by the
City;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: that the Mayor is authorized to execute the LGU'S Findings
of Facts, approving the filling of wetlands, and the new proposed Replacement Plan Application
for this project subject to the following conditions:
1. The replacement wetland must be monitored for a five (5) year period from the date
of completion.
2. The developer's wetland consultant shall be consulted and conduct periodic
inspections during the constriction of all the newly created wetland basins.
3. The developer shall submit an annual monitoring report to the City of Plymouth on
the anniversary date of the completion of the replacement wetland for a period of
five (5) years containing information required in WCA rile 8420.0620.
4. The replacement wetland must be constricted concurrently with site grading.
5. Prior to disturbing any wetland area, the developer shall submit a letter of credit in
the amount of the cost of the Replacement Plan. The letter of credit shall extend
until completion of the five year monitoring period. If during the monitoring period
the replacement wetland does not perform as proposed in the plan, work as
necessary shall be undertaken by the developer to bring it into conformance.

6. A deed creating a restrictive covenant running with the land for the replacement area
must be recorded. The deed shall be submitted to the City for approval before
recording.
7. The developer shall comply with the City of Plymouth Ordinance 95-2 (Wetland
Buffer Standards).
8. The proposed grading plan shall be approved by Plymouth City Engineer, prior to
any work within the wetland area.
FURTHER BE IT RESOLVED THAT; the City will reimburse the developer the cost of the
proposed wetland mitigation up to the amount of the original financial guarantee provided by
Homestead Village to the City after all City engineering review expenses are subtracted. Any
additional cost to provide the mitigation is the responsibility of the developer.
