RESOLUTION 2004-237
APPROVING SITE PLAN AMENDMENT AND VARIANCE FOR THE CITY OF
PLYMOUTH TO ALLOW RE -CONSTRUCTION OF A SANITARY SEWER LIFT
STATION LOCATED AT 4000 LANCASTER LANE NORTH (2004056)
WHEREAS, the City of Plymouth has requested approval of a site plan amendment and
setback variance to allow re -constriction of the sanitary sewer lift station on property
located at 4000 Lancaster Lane North; and,
WHEREAS, the property is legally described as follows:
Lot 2, Block 1, Plymouth Plaza 4"' Addition, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
meeting and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
site plan and variance to allow re -constriction of the sanitary sewer lift station located at
4000 Lancaster Lane, subject to the following conditions:
1. This resolution approves the re -constriction of a sanitary sewer lift station, in
accordance with the application and plans received by the City on May 21, 2004,
except as may be amended by this resolution.
2. This resolution approves a setback variance of 22 feet to the front lot line, based upon
the following findings:
a) The particular size, shape and shallow depth (100 feet) of the parcel creates a
hardship, because without the variance, the lift station could not be re -constricted
on the site. The lift station building placement is dictated in part by State Law,

which requires a 50 -foot separation between the existing City well on the site and
any wastewater facilities. Additionally, the requested variance would provide for
essential services for the benefit of the community and would allow for reasonable
use of the land.
b) The specific conditions and circumstances related to this parcel and request are not
generally applicable to other properties in the C-2 district.
c) The request is not based exclusively upon a desire to increase value or income
potential of the property, but rather to allow re -constriction of an existing sanitary
sewer lift station.
d) The site conditions relating to the need for the variance were not created by the
landowner.
e) Granting the variance would not be detrimental to the public welfare or injurious
to other land or improvements in the neighborhood. The lift station would be
constricted with face brick and would be compatible with the character of the
surrounding development. In addition, the lift station would provide an essential
public service.
f) The granting of the variance would not impair an adequate supply of light or air to
adjacent properties, nor would it substantially increase congestion in the public
streets, increase the danger of fire, endanger the public safety, or substantially
diminish or impair property values within the neighborhood.
g) The requested variance is the minimum action required to eliminate the hardship.
3. The appropriate building permits must be obtained prior to constriction of the
building.
4. This approval shall expire one year after the date of approval, unless the property
owner or applicant has commenced the use, or unless the landowner or applicant has
received prior approval from the City to extend the expiration date for up to one
additional year, as regulated under Section 2 103 0. 06 of the Zoning Ordinance.
