HomeMy WebLinkAboutCity Council Resolution 2004-233CITY OF PLYMOUTH RESOLUTION 2004-233 APPROVING A FINAL PLAT FOR RYLAND HOMES, INC. FOR "THE FIELDS OF NANTERRE, SECOND ADDITION" LOCATED NORTH OF SCHMIDT LAKE ROAD AND WEST OF VICKSBURG LANE NORTH (2004043) WHEREAS, The Ryland Group has requested approval of a final plat for "The Fields of Nanterre, Second Addition", a plat of 52 townhouse lots and three common space lots on roughly 19.5 acres located north of Schmidt Lake Road and west of Vicksburg Lane North; and WHEREAS, the property is legally described as follows: Outlot A, The Fields of Nanterre WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by The Ryland Group for a final plat for The Fields of Nanterre, Second Addition; and, FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. Approval of the final plat is contingent upon the applicant executing and returning the development contract. 2. This final plat approves 52 townhouse lots and three common open -space lots, in accordance with the plans received by the City on April 26, 2004, and May 14, 2004, except as amended by this Resolution. Prior to recording the final plat, the developer shall pay the park dedication fees for all the units shown on the plans pursuant to City Code at the time of recording the final plat. 4. Prior to recording the final plat, the applicant shall submit the required easements as specified in the Engineer's Memo and as approved by the City Engineer. 5. Homeowner Association documents, covenants and restrictions shall be filed with the Final Plat. Proof of recording shall be furnished to the City. 6. Prior to issuance of building permits, the applicant shall submit a revised grading plan showing the location of the wetland buffer monuments in compliance with Section 21670 of the Zoning Ordinance. 7. Prior to issuance of building permits, the applicant shall submit the required disclosures to future homeowners concerning the active nature of the Canadian Pacific Railroad Line and the noise and vibration associated with it; the intention of the City to develop the parcel at the northwest corner of Schmidt Lake Road with a ground storage facility for drinking water and the potential for a fiiture fire station; and, that some units are not eligible for the conversion of decks into three- or four -season porches due to their proximity to the wetland buffer, other units or the perimeter setbacks. 8. Prior to installation of the mailbox strictures, an encroachment agreement is required between the developer and the City for the mail box strictures proposed within the right-of-way. 9. The HOA shall be responsible for maintenance of sidewalk, boulevard plantings, wetland buffers, mailboxes, monument signs and association common areas within this development. 10. The applicant shall be responsible for constricting the trail in the trail outlot across the entire project on both Schmidt Lake Road and Vicksburg Lane North. Financial guarantees for the completion of this item shall be included in the Development Contract. 11. The applicant shall install street lights similar to those used in the existing Nanterre development to the south. 12. All signage shall comply with the Sign Ordinance. No variances are granted or implied. 13. Development standards shall be as required by the RMF -2 district. No variances are granted or implied. 14. All sidewalks internal to the development shall be privately maintained, including those adjacent to Archer Lane North, 50"' Avenue, Yuma Lane North, and Weston Lane North. Resolution 2004-233 (2004043F) Page 3 15. All buildings in the development shall be protected by a City approved NFPA 1313 automatic fire sprinkler system approved by the City. 16. A fence, not exceeding six feet in height, shall be provided for privacy and screening in the front yard along Schmidt Lake Road as shown on the landscape plan. The fence shall be owned and maintained by the homeowners association. 17. Shrub plantings throughout the development shall be as approved with the preliminary plat and site plan and shown on plans received by the City on April 9, 2002. 13. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. No building permits shall be issued until a contract has been awarded for sewer and water. c. No building permits shall be issued until the final plat is filed and recorded with Hennepin County and proof of recording is submitted to the City. d. Prior to the issuance of any utility or building permits, fire flow calculations in conformance with City ordinances and policies, shall be submitted and approved. e. Compliance with the City Code regarding the location of fire hydrants and fire lane signage. Specifically, the hydrant located on the corner of Yuma Lane and 50t1' Avenue must remain. f. Street names shall comply with the City Street Naming System. g. Removal of all hazardous trees from the property at the owner's expense. h. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility.
