HomeMy WebLinkAboutCity Council Resolution 2004-225CITY OF PLYMOUTH RESOLUTION NO. 2004-225 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF RESOLUTION NO. 2004-224 VACATING A PORTION OF THE DEDICATED ALLEY WITHIN THE PLAT OF ELMHURST WHEREAS, the City Council has authorized the vacation of a portion of the platted alley within Elmhurst by Resolution No. 2004-224. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That said resolution shall not be filed until: 1. A public drainage and utility easement document over the vacated portion of the alley within Elmhurst has been submitted and accepted by the City of Plymouth for recording at Hennepin County. 2. A private access easement over part of Lots 11, 12, and 13, Block 1, Elmhurst for the benefit of the 4 lots to the north and adjacent to Goldie Avenue has been submitted and accepted by the City of Plymouth for recording at Hennepin County. The legal description of the private access easement must cover the areas currently used by the residents for access or an alternative location acceptable to the owners of the 4 lots. Supporting documentation needed to verify this must be submitted. Adopted by the City Council on June 8, 2004.
