HomeMy WebLinkAboutCity Council Resolution 2004-208CITY OF PLYMOUTH RESOLUTION 2004-208 APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR QUEST REAL ESTATE, INC. FOR "WOODS AT MEDICINE LAKE", A 26 -UNIT RESIDENTIAL DEVELOPMENT TO BE LOCATED AT 10730 SOUTH SHORE DRIVE (2003089F) WHEREAS, Quest Real Estate, Inc. has requested approval of a final plat for the Woods at Medicine Lake, a plat of 27 lots for 26 townhouse unit lots and one outlot on 5.3 acres located at 10730 South Shore Drive; and WHEREAS, the property is legally described as follows: All that part of the North 50 rods of the Northwest quarter of the Northwest quarter lying East of the Center line of County Road No. 70 and lying south of the North 316 feet thereof in Section 36, Township 118, Range 22, Hennepin County, Minnesota, according to the United States Government Survey thereof. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Quest Real Estate, Inc. for final plat for the "Woods at Medicine Lake"; and, FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: Approval of the final plat is contingent upon the applicant executing and returning the development contract. This final plat approves 26 townhouse unit lots and one outlot, in accordance with the plans received by the City on May 20, 2004, except as amended by this Resolution. 3. Prior to recording the final plat, the applicant shall submit the required easements and pond maintenance agreement as approved by the City Engineer as specified in the Engineer's Memo. 4. Prior to recording the final plat, the developer shall pay the park dedication fees, pursuant to City Code at the time the final plat is approved, for the total number of units shown on the plans. 5. Prior to issuance of building permits, the applicant shall provide the City with a revised landscaping plan in conformance with the Zoning Ordinance, specifically demonstrating that sod will be installed in all the disturbed areas outside the wetland buffer with the exception of the water -quality pond and seed of an appropriate mixture shall be used within the wetland buffer areas. 6. Prior to issuance of building permits, the buffer monument signs and the small interpretive signs shall be installed as shown on the approved plans and pursuant to Ordinance requirements. 7. Prior to issuance of building permits, the applicant shall provide the City with copies of disclaimers informing future homeowners that at -grade patios and decks are not allowed to encroach into the required stricture setbacks to South Shore Drive or beyond the unit lot line. 8. Prior to issuance of building permits, the applicant shall submit proof that the plat, homeowner association documents, easements and agreements have been recorded. 9. Prior to release of all financial guarantees, the applicant shall install a street light at the intersection of the private drive and South Shore Drive. 10. The HOA shall be responsible for maintenance of the private drives, sidewalks, boulevard plantings, wetland buffers, mailboxes, monument signs and association common areas within this development. The HOA documents shall include language prohibiting the storage of recreational vehicles in the guest parking spaces. 11. Development standards shall be as required by the RMF -2 districts. No variances are granted or implied, except those specifically listed in the resolution approving the site plan. 12. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. Resolution 2004-208 Final Plat (200308917) Page 3 c. Prior to recording the final plat, the applicant is eligible for one building permit per legal parcel. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e. No building permits shall be issued until a contract has been awarded for sewer and water. f. Prior to issuance of building permits, the applicant shall show the temporary access road/water supply policy, fire lane constriction detail, and no parking/fire lane signage detail on the plans. g. All strictures shall be protected by a City approved, monitored, automotive fire sprinkler system and the site shall be served by a looped water main system. h. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement financial guarantees per City Policy. i. Prior to the issuance of building permits, the applicant shall revise plans as necessary to add and relocate hydrants to approved locations; incorporate 45 -foot inside turning radius from all directions on the private drives; identify the domestic size of the combination fire/domestic water supply line; provide a solenoid device on each fire sprinkler system and system flow switch to domestic water; supply a PIV valve lockbox and siamese connection if required; and show fire lane, address and directional signs in approved locations. j. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. k. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 512 of City Code.
