HomeMy WebLinkAboutCity Council Resolution 2004-203CITY OF PLYMOUTH RESOLUTION NO. 2004-203 APPROVING LEASE AGREEMENT BETWEEN AERO SYSTEMS ENGINEERING, INC. ("LESSOR") AND CITY OF PLYMOUTH ("TENANT") WHEREAS, the City is in need of a fill site for the purposes of stockpiling clean uncontaminated fill soils; and WHEREAS, Aero Systems Engineering, Inc. (ASE) owns a facility located at 13825 Schmidt Lake Road which has direct access off of Schmidt Lake Road; and WHEREAS, the Aero Systems Engineering, Inc. property has a large low area in the southeast part of their property which they do not intend to develop, and are agreeable to allowing the City to use as a fill site; and WHEREAS, a lease agreement has been prepared to allow the City to use this area for stockpiling clean uncontaminated fill soils subject to the terms of a Lease Agreement; and WHEREAS, the City will need to replace the existing gate adjacent to this fill area with a larger gate to provide for this dumping operation to occur; and WHEREAS, the Lease Agreement requires the City to repave the existing paved entrance drive and pave the two existing gravel parking lots north of their building immediately off of Schmidt Lake Road; and WHEREAS, the ASE property available for fill is adjacent to City owned property to the east which also has low areas which can be filled, the total of which is approximately 150,000 cubic yards; and WHEREAS, the Lease Agreement is for a term of three years commencing upon execution of the Lease Agreement by both parties and it shall automatically renew for addition three year terms unless terminated by either party upon a one year prior written notification to terminate. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the Lease Agreement with Aero Systems Engineering, Inc. is approved and the Mayor and City Manager are authorized to sign the agreement. Adopted by the City Council on May 25, 2004.
