HomeMy WebLinkAboutCity Council Resolution 2004-196CITY OF PLYMOUTH RESOLUTION 2004-196 APPROVING ENCROACHMENT AGREEMENT FOR STORM SEWER CONSTRUCTION AT 9700-37 TH PLACE NORTH WHEREAS, Robert L. Melamed as Managing Partner has requested approval to execute an encroachment agreement to constrict a private storm sewer system within City of Plymouth park property identified as Park No. I Plymouth Plaza 3rd Addition; and WHEREAS, the encroachment agreement only permits the constriction of a private storm sewer system as shown on constriction plans attached to the agreement to address an existing drainage problem at 9700 — 37th Place; and WHEREAS, the private property being granted permission to constrict a storm sewer system encroaching onto Park No. I Plymouth Plaza 3rd Addition is legally described as Lot 1, Block 3 Plymouth Plaza 4th Addition; NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on behalf of the City of Plymouth an encroachment agreement that will allow constriction of a private storm sewer system within Park No. I Plymouth Plaza 3rd Addition. ADOPTED by the City Council this 25th day of May, 2004. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS. The undersigned, being the duly qualified and appointed City Clerk of the City of Plymouth, Minnesota, certifies that I compared the foregoing resolution adopted at a meeting of the Plymouth City Council on May 25, 2004, with the original thereof on file in my office, and the same is a correct transcription thereof.
