HomeMy WebLinkAboutCity Council Resolution 2004-189CITY OF PLYMOUTH RESOLUTION 2004-189 APPROVING A SITE PLAN AMENDMENT AND CONDITIONAL USE PERMITS TO ALLOW AN AIR -SUPPORTED DOME OVER THE ATHLETIC FIELD AT CENTRAL MIDDLE SCHOOL AND RELATED IMPROVEMENTS FOR PROPERTY LOCATED AT 305 VICKSBURG LANE (2004028) WHEREAS, Cuningham Group Architecture, P.A. has requested approval of a site plan amendment and conditional use permits to install an air -supported dome over a portion of the athletic field and related improvements on property legally described as follows: The Southeast quarter of the Southeast quarter; the South 535.4 feet of the Northeast quarter of the Southeast quarter; and the South 535.4 feet of the East 10 acres of Government Lot 7, all in Section 32, Township 118 North, Range 22, subject to all easements of record for road purposes over the strip of land I rod wide North of the South line of said above described Southeast quarter of Southeast quarter of Section 32, Township 118 North, Range 22; and subject to all public roadways now existing on said property to wit; a town road over the East 33 feet of the Southeast quarter of Section 32, Township 118 North, Range 22; and County Road 15. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Cuningham Group Architecture, P.A. to allow the installation of an air -supported dome and related improvements on property located at 305 Vicksburg Lane, subject to the following conditions: 1. A site plan amendment is approved to allow an air -supported dome to enclose a 174 -foot by 374 -foot area and related improvements, in accordance with the plans received by the City on March 19, 2004 and April 8, 2004, except as may be amended by this resolution. Conditional use permits are approved to allow the air -supported dome installed at 58 feet in height and an eight -foot fence to enclose the storage and mechanical area, based on the findings that the applicable standards in Section 21015 have been met. 3. Separate building permits are required prior to the commencement of any constriction related to the project. 4. Prior to the issuance of any permits, the applicant shall conduct a spring verification of the delineated wetland boundary and revise the plans to incorporate the east side of that boundary. 5. Prior to the issuance of any permits, the applicant shall submit the required photometry and fixture details of the lights proposed at the main pedestrian entrance to the dome in compliance with the Zoning Ordinance. 6. Prior to the issuance of any permits, the landscaping plan shall be revised to substitute two deciduous trees for two of the proposed coniferous trees. 7. All signage shall comply with the sign ordinance. 8. All activities shall cease within the dome and the lights turned off by 10:30 pm. 9. The dome shall be constricted of fabric that is opaque for the first forty feet above grade as proposed in the letter received May 3, 2004 from the Wayzata Public Schools Board of Education. 10. Prior to issuance of any permits for the project, the landscaping plan shall be revised to incorporate six additional trees, a two -foot increase in the planting height of 50 percent of the coniferous trees, relocating the perimeter fence at the south edge of the property as proposed in the letter received May 3, 2004 from the Wayzata Public Schools Board of Education. 11. A supervisor shall be on-site at all times the building is open, whose responsibility is to monitor the activities inside the dome and concessions/toilet building as proposed in the letter received May 3, 2004 from the Wayzata Public Schools Board of Education. Further, the school district shall require community groups to provide adequate adult supervision for the participants. 12. The school district shall propose changes to the driveway entrances and drop-off area to improve congestion within the site and at the Vicksburg Lane driveways in the vicinity of 2" a Avenue by September 1, 2004. 13. Standard Conditions: a. Compliance with the City Engineer's Memorandum. Resolution 2004-189 (2004028) Page 3 b. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. c. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. d. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21015.07 of the Zoning Ordinance.
