HomeMy WebLinkAboutCity Council Resolution 2004-185CITY OF PLYMOUTH RESOLUTION 2004-185 APPROVING SITE PLAN AMENDMENT AND VARIANCE FOR THE CITY OF PLYMOUTH TO ALLOW EXPANSION AND RENOVATION OF THE ZACHARY WATER TREATMENT PLANT 4295 ZACHARY LANE NORTH (2004029) WHEREAS, the City of Plymouth has requested approval of a site plan amendment and variance to allow expansion and renovation of the Zachary Water Treatment Plant located at 4295 Zachary Lane North; and, WHEREAS, the property is legally described as follows: Lot 1, Block 1, City of Plymouth Plat No. 2. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the site plan amendment and variance to allow expansion and renovation of the Zachary Water Treatment Plant located at 4295 Zachary Lane, subject to the following conditions: 1. This resolution approves a site plan amendment and variance for expansion of the Zachary Water Treatment Plant, in accordance with the plans received by the City on March 19, 2004, except as may be amended by this resolution. 2. This resolution approves a variance to allow an unloading area 120 feet from the west lot line, based upon the finding that all application variance standards are met. 3. The appropriate building permits must be obtained prior to commencement of the expansion and renovation project. Resolution 2004-185 (2004029) Page 2 4. The unloading area on the west side of the building shall be used only for the unloading of potassium permanganate totes, roughly once per month during weekday hours. Any other loading/unloading operations related to the building shall continue to occur on the east side of the building. 5. This approval shall expire one year after the date of approval, unless the property owner or applicant has commenced the use, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 2 103 0. 06 of the Zoning Ordinance.
