HomeMy WebLinkAboutCity Council Resolution 2014-134CITY OF PLYMOUTH RESOLUTION No. 2014-134 RESOLUTION EXTENDING EMERGENCY DECLARATION TO ALLOW THE COMPLETION OF THE REPAIRS TO THE FAILING CULVERT UNDER FERNBROOK LANE AT PLYMOUTH CREEK WHEREAS, a local emergency may be declared only by the mayor or their legal successors and it may not be continued for a period in excess of three days except by or with the consent of the governing body of the political subdivision.; and WHEREAS, the large corrugated metal culvert under Fernbrook Lane at Plymouth Creek failed causing the road to collapse resulting in the closure of Fernbrook Lane; and WHERAS, on April 8t", 2014, the Mayor declared an emergency; and WHEREAS, the replacement of the failed culvert may not be complete by the period of four weeks included in the declaration; and WHEREAS, the next available meeting of the City Council is May 13, 2014 which is beyond the original period of the emergency declaration, and WHEREAS, in order to complete the needed improvements the emergency declaration should be extended for a period of three more weeks. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the emergency declaration for the repair of the Fernbrook Lane culvert at Plymouth Creek extension for three more weeks is hereby approved and staff is hereby authorized to purchase materials and hire contractors as needed and the City Manager is hereby authorized to approve contracts as needed.
