RESOLUTION No. 2014-132
A RESOLUTION APPROVING A PRELIMINARY PLAT AND VARIANCE FOR
LANDFORM PROFESSIONAL SERVICES FOR "ROSE GARDEN" FOR PROPERTY
LOCATED SOUTH OF HIGHWAY 55 AND WEST OF COUNTY ROAD 101 (2014007)
WHEREAS, Landform Professional Services has requested approval of a preliminary plat and
variance for roughly 9 acres of land presently legally described as follows:
That part of the West Half of the Northwest Quarter of the Northeast Quarter of Section 18,
Township 118, Range 22, lying South of State Highway No. 55 as now traveled and used,
Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Landform Professional
Services for a preliminary plat and variance for Rose Garden, subject to the following conditions:
1. A preliminary plat is approved for 20 two-family dwelling units in accordance with the development
plans submitted to the city on February 7, 2014 and revised plan submitted to the city on April 16,
2014, except as amended by this resolution.
2. Approval of the preliminary plat is contingent upon City Council approval of the rezoning of the site.
3. Approval of any final platting for this development is contingent upon prior City Council approval of
a wetland replacement plan application.
4. A variance is approved to allow private drive access onto future Hamel Road, which is shown as a
major collector roadway on the city's comprehensive plan, with the finding that the applicable
variance standards would be met, and with the condition that the developer provide 0.5 guest
parking spaces per dwelling unit, with at least six guest parking spaces along the north private drive
and at least four guest parking spaces along the south private drive.
5. There shall be no grading or filling of wetland until a wetland replacement plan application is
reviewed and approved by the City Council.
6. In conjunction with the construction of Hamel Road, the developer shall install a city trail within the
right-of-way on the south side of Hamel Road. The development contract related to final platting
will address specifications and reimbursement of pavement costs for the trail.
7. In conjunction with submission of the final plat application, the developer shall submit homeowner's
association documents for city review. The homeowner's association documents shall address: a)

responsibilities for maintenance of the wetland areas within the site, wetland buffers, buffer
monuments, retention basin, private drive system, signage (including required address signs and "no
parking -fire lane" signs), and any other similar or common features; b) prohibition on structures and
the clearing of native vegetation from the wetland buffers; c) individual unit driveways extending
onto neighboring unit lots; and d) maintenance of and access to private utilities (e.g., sewer and
water services) that cross individual property lines onto association property.
8. In conjunction with submittal of the final plat application, a revised tree preservation plan must be
provided that: a) shows removal of deciduous trees under eight inches in diameter and off-site
trees from the inventory; b) bases the calculations on diameter inches of trees preserved as
opposed to the number of trees preserved; and c) counts trees #118 through #125 as being
removed instead of preserved.
9. In conjunction with submission of the final plat application, the developer shall provide 40 new front
yard trees.
10. In conjunction with submittal of the final plat application, the developer shall address the design
specifications for the private drive system (pursuant to section 21137 of the zoning ordinance),
including the requirement that the private drive system be constructed and surfaced in a manner to
distinguish it from a public street.
11. Prior to recording the final plat, the developer shall:
a) Revise the plans to indicate required standard drainage and utility easements around the
perimeter of site.
b) Enter into an agreement to be assessed for one half of the cost of a future city project to
construct the Hamel Road segment lying along the east boundary of the site.
c) Revise the plans to relocate new trees to be planted so they are out of the wetland buffer.
d) Revise the plans to identify the seed mix to be used in the wetland buffer, consistent with city
requirements.
e) Pay the area assessments or agree to be assessed for water main and sanitary sewer area
charges.
f) Receive city approval of final construction plans.
g) Pay the required park dedication fee.
h) Obtain watershed approval.
i) Submit a recordable bio -retention basin maintenance agreement for city review. Upon city
approval, the bio -retention basin maintenance agreement shall be recorded with the final plat.
j) Ensure that access is provided to wetlands.
k) Provide an encroachment agreement where retaining walls are located in drainage and utility
easements.
12. Prior to commencement of site development including grading operations, the developer shall:
a) Install and request inspection of tree protection fencing (silt fence).
b) Obtain the necessary MnDOT permits for drainage and work within Highway 55 right-of-way.
c) Obtain the required NPDES (National Pollutant Discharge Elimination System) permit.

13. Prior to issuance of building permits, the developer shall install permanent wetland buffer
monument signs pursuant to ordinance requirements.
14. Standard Conditions:
a. No building permits shall be issued until the final plat is filed and recorded with Hennepin
County.
b. Development standards and setbacks for this plat shall comply with the RMF -2 zoning standards.
No variances are granted or implied.
c. Any signage shall require separate permits and shall comply with the city's sign regulations.
d. An approved looped watermain system is required with a minimum of two separate connections
to the Highway 55 watermain or to the watermain extending from the development to the
southeast of the site.
e. Fire flow calculations must be submitted showing flows to the two highest elevation hydrants on
the dead end water main simultaneously. Each hydrant shall flow a minimum of 1500 gallons
per minute at 20 pounds per square inch residual pressure. Additional gallons per minute may
be required based on the total square footage of each structure.
f. The range of addresses must be posted on signage visible from Hamel Road near the private
drive entrances.
g. Fire lane signage shall be required along the private drive system as approved by the Fire
Inspector.
h. Hydrants along the northwest private drive must be relocated to approved locations.
i. Removal of all hazardous trees at the owner's expense.
j. No trees shall be planted in the boulevard.
k. This approval shall expire one year after the date of approval, unless the property owner or
applicant has applied for final plat approval, or unless the applicant, with the consent of the
landowner, has received prior approval from the city to extend the expiration date for up to one
additional year, as regulated under section 510 of city code.
