HomeMy WebLinkAboutCity Council Resolution 2014-109CITY OF PLYMOUTH RESOLUTION No. 2014-109 A RESOLUTION APPROVING A SITE PLAN AND VARIANCE FOR UNITED PROPERTIES FOR A NEW OFFICE BUILDING FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER OF SCHMIDT LAKE ROAD AND HIGHWAY 169 (2013098) WHEREAS, United Properties has requested approval of a site plan and variance to allow a new single -story, 10,040 square foot office building for property legally described as follows: That part of Lots 2 and 3, Block 1, Epiphany Second Addition, which lies Easterly, Northerly, Northeasterly, and Easterly of the following described line: Commencing at the Southwest corner of said Lot 2; thence on an assumed bearing of East, along the South line of said Lot 2 a distance of 350.51 feet, to the Southeast corner of said Lot 2 and the point of beginning of the line to be described; thence North 09 degrees 54 minutes 33 seconds West, along the East line of said Lot 2 a distance of 161.18 feet to a corner of said Lot 2; thence South 79 degrees 56 minutes 00 seconds West, along said East line of Lot 2 a distance of 19.94 feet; thence North 51 degrees 42 minutes 13 seconds West a distance of 184.22 feet; thence on a bearing of North a distance of 144.55 feet to the North line of said Lot 2 and said line there terminating. Together with appurtenant easement(s) contained in Document No. 2827514 as amended by 4414361 and 4325673. Being registered land as evidenced by Certificate of Title No. 1339905. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by United Properties for a site plan and variance to allow construction of a new office building, subject to the following conditions: A site plan is approved to construct a new office and related site improvements, in accordance with the plans received by the city on October 7, 2013, October 23, 2013, and February 25, 2014, except as amended by this resolution. 2. A variance is approved to allow a front (east) setback of 23 feet where 50 feet is specified, with the finding that all applicable variance standards have been met. 3. A separate building permit is required prior to commencement of the project. Resolution 2014-109 File 2013098 Page 2 4. Prior to issuance of a building permit, the applicant shall fulfill the requirements and submit the required information, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. The developer shall receive city approval of final construction plans. b. The developer shall provide a maintenance agreement in recordable form for the rain garden. c. The developer shall pay the required park dedication fee. d. The developer shall enter into a site improvement performance agreement for the exterior site improvements, and shall provide the related financial securities and fees. 5. Silt fence shall be installed prior to any grading or construction on the site. 6. Standard Conditions: a. Any rooftop equipment shall be painted to match the building. b. The applicant shall remove any diseased or hazardous trees. c. Signage shall receive required sign permits and shall comply with section 21155 of the zoning ordinance. No signage variances are granted or implied. b. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21045.09 and 21130.06, respectively, of the zoning ordinance.
