RESOLUTION No. 2014-106
RESOLUTION ACCEPTING DONATION OF PERMANENT EASEMENT
FOR STREET, DRAINAGE AND UTILITY PURPOSES
WHEREAS, Donald E. Levens and Beverly K. Levens, husband and wife, are fee owners
("Owners") of real property located within the City of Plymouth legally described as follows:
Lot 5 and the East 1/2 of Lot 6, Block 1, Medicine Lake Park First Division, Hennepin County,
Minnesota,
(the "Levens Property"); and
WHEREAS, Owners desire to donate a permanent easement for street, drainage and utility
purposes to the City of Plymouth over a portion of the Levens Property legally described and
depicted on the attached Exhibit "A" (the "Easement Property"); and
WHEREAS, such donation will benefit the citizens of the City; and
WHEREAS, Owners have executed the Grant of Permanent Easement for the purpose of
granting the Easement Property to the City, and the Grant of Permanent Easement will be recorded
upon adoption of this Resolution at the sole expense of the City; and
WHEREAS, Minnesota Statutes Section 465.03, requires that donations of real property or
personal property be accepted by a resolution of the City Council adopted by a two-thirds majority
of its members.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. The City Council hereby accepts the donation of the Easement Property by Owners.
2. The Mayor and City Manager are authorized to execute any documents which, in the opinion of
the City Attorney, are necessary to effectuate this transaction. The City Clerk is specifically
designated as the person who can sign IRS Form 8283.

The undersigned, being the duly qualified and appointed City Clerk of the City of Plymouth,
Minnesota, certifies that I compared the foregoing resolution adopted at a meeting of the
Plymouth City Council on April 8, 2014, with the original thereof on file in my office, and the
same is a correct transcription thereof.
