RESOLUTION No. 2014-104
A RESOLUTION APPROVING A FINAL PLAT FOR LDK BUILDERS, INC., FOR "SPRING
MEADOWS 3RD ADDITION" FOR FOUR SINGLE-FAMILY LOTS FOR PROPERTY LOCATED AT
THE NORTHEAST CORNER OF DUNKIRK LANE AND 54TH AVENUE 2014014-F)
WHEREAS, LDK Builders, Inc., has requested approval of a final plat to allow a
subdivision containing four single-family lots on the roughly 1.31 -acre site presently legally
described as follows:
Outlot B, Spring Meadows 2nd Addition, Hennepin County, Minnesota
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by LDK Builders, Inc. for a final plat for Spring Meadows 3rd Addition; and
FURTHER, that the following conditions be met prior to recording of, and related to said
plat:
1. A final plat is approved for the creation of four single-family lots, in accordance with the
application, plat and plans received by the city on March 7, 2014 except as may be amended
by this resolution.
2. Setbacks for this development shall comply with the RSF-3 zoning standards; no variances
are approved or implied.
3. Prior to release of the final plat for recording, the following items shall be addressed:
a. Vacate right-of-way easement document number 1781439.
b. Provide HOA documents incorporating the Spring Meadows 3rd Addition into the Spring
Meadows HOA, and include language addressing the following: 1) maintenance for
common elements including any developer installed retaining walls, filtration basins,
association common spaces, sidewalks, landscaped areas including the vegetation around
the ponds inside the fenced -in area; and 2) notification regarding the Plymouth Gun Club,
its hours of operation, that repetitive loud noise is produced during those hours and that
its hours are subject to change.
c. Submit separate disclosures indicating the presence of the Gun Club, its hours of
operation, that repetitive loud noise is produced during those hours and that its hours are
subject to change.

4. Prior to issuance of any building permits, the applicant shall:
a. Provide verification of the installation of the corner monuments from a certified surveyor.
b. Submit a certified survey for each lot indicating a minimum of two front yard trees to be
planted and submit a refundable cash deposit to guarantee the planting of those trees for
each lot.
c. Provide a signed city -approved shooting range protection act disclaimer from the
property owner for any home located within 750 feet of the gun club.
5. Standard conditions:
a. No building permits shall be issued until the final plat and all easements and agreements
are filed and recorded with Hennepin County and proof of recording is submitted to the
city.
b. Any signage shall require separate permits and shall comply with the city's signage
regulations.
c. Separate building permits are required for retaining walls 48 inches in height or higher.
Additionally, a fence shall be installed at the top of retaining walls that exceed four feet
in height.
d. Removal of all hazardous trees from the property at the owner's expense.
e. Adjacent paved streets shall be kept free of mud, sand, and silt as a result of construction.
f. This approval shall expire two years after the date of approval, unless the property owner
or applicant has recorded the final plat, or unless the applicant, with the consent of the
property owner, has received prior approval from the City to extend the expiration date
for up to one additional year, as regulated under Section 512 of City Code.
