HomeMy WebLinkAboutCity Council Minutes 05-01-1995 BOECITY OF PLYMOUTH MINUTES 1995 RECONVENED BOARD OF REVIEW MAY 19 1995 The 1995 Board of Review of the City of Plymouth was reconvened by Mayor Tierney at 7:00 p.m. in the Council Chambers of the City Center, 3400 Plymouth Blvd., on May 1, 1995. PRESENT: Mayor Tierney; Councilmembers Wold, Edson, Helliwell, and Lymangood. ABSENT: Councilmembers Anderson and Granath. STAFF PRESENT: City Manager Johnson, Assistant Manager Lueckert, Finance Director Hahn, City Assessor Bye, Senior Appraiser Olsson, Appraiser Carroll, Appraiser McCormick, Appraiser Kingsbury, Commercial Appraiser Zent, and City Clerk Ahrens. Mayor Tierney noted that the City Council has received staff reports relating to each property for which objections were received at the April 10 Board of Review. Michael Swanson, 6000 Kirkwood Lane North, (02-118-22-24-0011) Michael Swanson, 6000 Kirkwood Lane North, summarized his appeal made at the April 10 Board of Review meeting. He requested that his 1994 estimated market value be reduced to $117,000, and his 1995 value be reduced to $123,000. MOTION was made by Councilmember Edson, seconded by Councilmember Lymangood, to direct staff to contact Hennepin County to request that the estimated market value for 1994 be reduced to $117,000 and to reduce the estimated market value for 1995 to 124,000. Councilmember Edson said that his motion to reduce the parcel value is influenced by Mr. Swanson prevailing in previous tax court action on this parcel. Motion carried, five ayes. Reconvened Board of Review May 1, 1995 Page 4 Allen and Mary Jo Asmus, 2545 Troy Lane North, (30-118-22-21-0019) Mr. and Mrs. Asmus, 2545 Troy Lane North, summarized their appeal and requested that their value be reduced from $160,900 to $140,500. Mrs. Asmus presented information supplied by two real estate companies. She said the information indicates that the market value of the property is between $153,000 and $154,000. However, she believes that the City's assessed value should be about 90 to 95 percent of market value. She also provided information about recent sales where the properties sold for more than the City's assessed value. She noted that the comparables provided by staff have four bedrooms, whereas, their property has three bedrooms and a den. Assessor Bye stated that if the den is large enough and has a closet, it could be considered a bedroom. In response to a question by Councilmember Edson, Mr. Asmus stated they purchased the home for $132,000 in 1986. Mrs. Asmus stated that when they purchased the home, the window seals were broken, the bathroom floor needed replacement, and underground water problems had not been disclosed. MOTION was made by Mayor Tierney, seconded by Councilmember Helliwell, that the value of the parcel be reduced to $150,000. Motion carried, five ayes. Roger Biorlin, 12110 54th Avenue North, (11-118-22-21-0046) Roger Bjorlin, 12110 54th Avenue North, summarized his appeal. He said that significant repair work is needed outside of the home, including rotted sills, driveway replacement, and cement work. Mr. Bjorlin stated that although his property has lake frontage, the value of the property is reduced due to the home constructed on the lot. He believes that an increase in value of $9,300 over two years is excessive. He requested a value reduction by $5,000, so that there would be only a $4,300 increase in value over two years. Councilmember Helliwell recalled that the Council had reduced the value on this parcel a couple of years ago in order to allow Mr. Bjorlin to put money into needed maintenance on the property. She asked what had been completed. Mr. Bjorlin said a bathroom was repaired, the home was redecorated with carpet and wallpaper replacement. Also, about $3,000 was spent on roof repair. MOTION was made by Councilmember Helliwell, seconded by Councilmember Lymangood, that the value of this parcel be reduced to $159,800. Reconvened Board of Review May 1, 1995 Page 5 Assessor Bye suggested that the property owner may wish to investigate the two property tax refund programs available through the State. Motion carried, five ayes. David and Jayne Douglas, 2510 Yuma Lane North, (29-118-22-11-0020) David and Jayne Douglas, 2510 Yuma Lane North, summarized their appeal. Mr. Douglas requested a reduction in value based on an average sales ratio in his neighborhood of 95.6 percent and an appraisal conducted on their parcel for refinancing purposes that resulted in a value of $314,727. He requested a reduction in value to 300,880. Assessor Bye stated that staff recommends no change in the 1995 estimated market value. Staff believes some of the adjustments in the refinancing appraisal for size and amenities are questionable. Mayor Tierney noted that there were improvements done to the property in 1992 and 1993. She asked if this was considered in the refinancing appraisal. Mr. Douglas stated the improvements were done before the refinancing appraisal was completed. Councilmember Edson asked the amount that was spent on improvements. Mr. Douglas responded that he did the labor himself. The material cost was about $7,000. Councilmember Edson stated that the property was purchased in 1991 for $300,000. Based on the improvements that were done since that time and the average increases in value experienced by Plymouth properties, the current value of $329,800 does not seem excessive. He noted that an increase of 4 percent each year, with no improvements, would result in a value greater than $329,800. MOTION was made by Councilmember Edson, seconded by Councilmember Lymangood, that the value of 2510 Yuma Lane North remain unchanged at $329,800. Motion carried: four ayes; Lymangood nay. Scott and Beth McGinnis, 4330 Hemlock Lane North, (14-118-22-12-0016) Scott and Beth McGinnis, 4330 Hemlock Lane North, summarized their appeal. Mr. McGinnis stated they have lived in Plymouth since August, 1993, and their value has increased by over 27 percent in that time. He asked why there was a change in the 1993 value between the time it was established by the City at $145,400 and when taxes were levied by Hennepin County the following year based on the value of $136,500. He Reconvened Board of Review May 1, 1995 Page 6 believes that this reduction in value was not recognized by the City, because the following year the value remained at $145,400. Assessor Bye explained that the value remained at $145,400. Hennepin County calculated a different taxable value based on a State law referred to as the "limited law." They were taxed based on the lower limited amount for 1994 taxes payable, but the estimated market value remained unchanged. Mr. McGinnis stated that the comparables provided by staff had more bathrooms and bedrooms and were larger than their home. He provided information on other properties that they feel are more comparable in nature, and requested a reduction in value to 119,300. Councilmember Edson stated that this amount would be less than they paid for the home two years ago. MOTION was made by Councilmember Edson, seconded by Mayor Tierney, that the value of this parcel be reduced to $148,200. Motion carried: four ayes; Lymangood nay. Mary Haves, 300 Zircon Lane North, (31-118-22-32-0027) Mary Hayes, 300 Zircon Lane North, stated that her home is valued too high. She said that her home is the smallest in the neighborhood, and there is only 35' from her deck to the neighbor's home. Her home contains few amenities. She compared her property to others in the subdivision and said that parcels with more amenities and greater privacy have values similar to her value. Mayor Tierney noted that earlier in the meeting the Council adopted a motion that no change be made to the value. She asked if any Councilmember wanted to reconsider that action. No motion was made.
