HomeMy WebLinkAboutCity Council Resolution 2013-073CITY OF PLYMOUTH RESOLUTION No. 2013-073 A RESOLUTION APPROVING A PRELIMINARY PLAT AND VARIANCE FOR "TERRA VISTA 3RD ADDITION" FOR PROPERTY LOCATED AT 5825, 5875, AND 5925 VICKSBURG LANE AND OUTLOT A TERRA VISTA (2012097) WHEREAS, GWS Land Development of Plymouth, LLC. has requested approval of a preliminary plat for the 15 acres presently legally described as follows: Parcel 1: The north 300 feet of the south 930 feet of the east 759 feet of the northeast quarter of Section 05, Township 118, Range 22, Hennepin County, Minnesota. Parcel 2: The north 300 feet of the south 630 feet of the east 759 feet of the northeast quarter of Section 05, Township 118, Range 22, Hennepin County, Minnesota. Parcel 3: The north 300 feet of the south 330 feet of the east 759 feet of the northeast quarter of Section 05, Township 118, Range 22, Hennepin County, Minnesota. Parcel 4: Outlot A, Terra Vista, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, GWS Land Development of Plymouth, LLC. has requested approval of a variance to lot width for the Lot 7, Block 2. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by GWS Land Development of Plymouth, LLC. for a preliminary plat and variance for "Terra Vista -1 Addition", subject to the following conditions: 1. A preliminary plat is approved to allow the property at 5825, 5875, and 5925 Vicksburg Lane and Outlot A, Terra Vista to be subdivided into 35 single-family lots, in accordance with the application and plans received by the city on November 15, 2012 and February 1, 2013, except as may be amended by this resolution. 2. Approval of the preliminary plat and variance is contingent upon City Council approval of the rezoning of the site to RSF-3. Res. 2013-073 File 2012097 Page 2 3. The preliminary plat is approved based on the site plan submitted on February 1, 2013 that indicates a full -access intersection at Vicksburg Lane. 4. A variance to lot width for Lot 7, Block 1 is approved in accordance with the application and plans received by the city of February 1, 2013, with the finding that the applicable variance standards have been met and subject to the condition that the home constricted on the lot meet the 15 -foot wetland buffer setback. 5. Prior to issuance of a 2radin2 permit, the applicant shall install and request inspection of silt fencing and tree preservation fencing. 6. Prior to recording the final plat, the applicant shall: 1) remove the home at 5825 Vicksburg Lane; 2) pay the park dedication cash fee with credit for land to be dedicated for trail outlots, in accordance with the ordinance in effect at the time the final plat is recorded; 3) pay sewer and water area assessments; 4) receive City approval of final constriction plans; and 5) execute a development contract and submit related financial guarantees. 7. Prior to final platting, the applicant shall fi lfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Provide HOA documents for the development that include language addressing the following: 1) prohibition of strictures and clearing vegetation in wetland buffers and 2) maintenance for common elements including buffer monuments, median plantings, mailboxes, monument signs, shared retaining walls, sidewalks, etc. b. Submit fire flow calculations with each phase of the development and provide the total square footage of the largest proposed stricture. c. Revise the plat to combine outlot A with the 30 -foot strip of land south of 5825 Vicksburg Lane. d. Consider revising the Wetland 4 buffer from 75 feet to 60 feet. e. Revise the grading plan to add and relocate wetland buffer monuments for all property included in the plat, consistent with section 21670.07 of the zoning ordinance. f. Revise the grading plan to indicate the 15 -foot required buffer setback on Lots 3-6, Block 1 to be measured from the proposed buffer. 8. Prior to the issuance of a building permit, the applicant shall submit a survey indicating: a. A minimum of two front yard trees to be preserved or planted, and b. Silt fence and tree preservation fencing installed consistent with city code. 9. When fi rther subdivision or development of Lots 14 or 15, Block 2 (5875 or 5925 Vicksburg Lane) occurs, all proposed lots and/or buildings shall be served with city sewer and water. At that time, private wells and on-site sanitary systems must be capped or abandoned in accordance with state and county regulations. Res. 2013-073 File 2012097 Page 3 10. The trail in the outlot between Lots C6 and C7 shall be constricted with the adjacent street. 11. Standard Conditions: a. With the exception of a model home, no building permits shall be issued until the final plat, agreements, and easements are filed and recorded with Hennepin County. b. Compliance with the city's tree preservation regulations. c. Removal of all hazardous trees from the property at the owner's expense. d. This approval shall expire one year after the date of approval, unless the applicant has applied for final plat approval, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 510 of city code.
